Maybe a silly question but if they seek to make someone bankrupt who has no assets and no prospect of making any payments doesn't it just cost them and save the bankrupt the bankruptcy fee?

Funny enough every bankruptcy order I have seen from Lowell portfolio has had a property with equity

Yikes! One of my debts is with Lowell and I have equity in my property. They bought my debt several years ago now and they've not done anything as yet; in fact I've not heard from them since 2009 (I've been paying them via CCCS) but maybe they will pull a sneaky when I'm least expecting it.

Thanks for the warning. I shall keep a look out for post from them just in case.
Debt 30k in 2008.:o Cleared all my debt in 2013 and loving being debt free :)
    Mortgage free since 2014 :)

Lowell are the DCA, Hamptons are the solicitors that they use to take the action

They are not the most pleasant of DCA...pond life.

I wound them up a little bit when I started my dmp in 2008 so I don't think they like me very much. I refused to be bullied by them and raised various complaints about their behaviour which is probably why I've not heard from them for a few years. However, I will now be waiting for them to try and get their own back. They can try.

  • Just got some letters of these people today. Threats of CCJs and then Bankruptcy or Charging Order over the property. I have to say that when in my arrangement to pay with them they were one of the easier ones to deal with, but one missed payment and straight to the throat. Good job the threats mean nothing to me now. Almost looking forward to posting them the letter with my copy BO!

Statutory demand from Lowells where someone has £60K of equity. Ouch!
