Or
Can they come hunting you down in a few years time if we ever pay anything off our mortgage?
In negative equity now!!
Assuming that they do not already have a CCJ or charge, then no they can't.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Could Lowell buying up or as they say they have been assingned your outstanding debts be an indication that they are considering you for a possible BR candidate??
The debts are of decent high value ie £20k near statute barred dates and they said in last letter to her that they had checked her credit records and knew she could pay these off (she has a decent wage but not that high) though if she was made BR an IPA would be quite high.
She is in the process of saving up her BR fees and should be going for BR end of July, just interesting that they have now ring fenced her largest debts.
Just my idea on what they are doing, maybe just a coincidence but would they have to inform her that they were intending to petition her for BR if they did they would save her the fees:D
Regards for any thoughts on this0 -
Lowell buy all sorts of debts, so in itself it indicates little. They are buying up a LOT of debt at the moment as well.
Maybe they will do her a favour though..... :cool:Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Well, honestly if you are only just asking about this now, then sounds like you have left it way too late.
Should really have made an application to have the stat demand set aside before this if you though you had grounds, and/or asked on forums/taken formal legal advice on how to defend.
You may be lucky and get a clued up judge who errs in your favour, but I would not necessarily hold my breath.
Good luck anyway.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Thank you. I have a solicitor representing me, found this forum and just needed some reassurance. The stat demand was not delivered but lowell say it was. It went to court today and the judge decided insufficient evudence of debt and found in my flavour and awarded costs so a victory. I would advise anyone to be aware lowell are a disgraceful company making money out of terrorizing people and causing mysery. They lie about delivering stat demands which guarantees them a court slot. I can't get over the trauma they have put me through.0

Ah! With you asking for help in that fashion, I assumed you were going into it cold and without help.
Well done anyway.
And yes, Lowell or their process servers do frequently tell porkies over the service of stat demands and sometimes even petitions themselves. There have been more than one case where the first the person knew was the actual BR order from the court landing on their doormat saying that they had been made bankrupt on such and such a date. :eek:Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Sorry, I was represented but I was in a real panic absolutely terrified of going to court. The judge did not accept the stat demand was not served because they had a statement from the process server Lewis Investigations. Itt definitely wasn't served I would immediately have it set aside. So anyone in a similar situation cannot rely on no stat demand as a defence.
Lowell continued to take me to court despite me disputing the debt back in August. Now the court case is over I am mindful to fire off complaints about these scumbags. Any suggestions? They should have their license revoked.
I thought I would share thus experience because it might help someone else. It seems lowell buy debt on mass and bankrupt people without gathering proper evidence expecting most to pay up out of fear. It's scandalous.0
