  • am i legally obliged to refund postage? or can i just refund sale cost?
  • As the seller it is YOUR job to ensure that the item gets to the buyer. If it gets lost in the post then YOU HAVE TO REFUND and yes, this is BEFORE you have made a claim with Royal Mail.

e.g. You buy a £1000 TV from https://www.Amazon.com. It gets lost in the post. Amazon says... sorry sir but you have to wait three months to see if we can claim the money back, then maybe we'll give you a refund.

Yeah right! Do the right thing and refund this guy. All he has do to is file a paypal claim and he'll get his money back, plus you would quite rightly deserve a big fat negative feedback.

Sorry If I'm a bit harsh, but its the way it is I'm afraid.
  • and yes,you have a refund the FULL amount + POSTAGE

If the buyer says he has not received his goods then you need to refund him both the item cost and the postage. His refund is not dependent on you reclaiming your money from the Royal Mail.

If you do not refund willingly he can easily do a paypal chargeback which will force you to refund and tie your paypal account up while you argue, but you will lose any chargeback as you cannot prove delivery.

  • Ah ok, i thought i needed to wait for royal mail to confirm that it was damaged/lost. Cos with the guys shady feedback it looks like he might be trying it on. He also wanted to contact me via phone the day after he bought my item, and also is asking for me to call him a different name to that on his paypal/ebay account... just sounded a bit wierd and was unsure how to go about it

Unfortunately there are a few scammers on ebay who will try and get goods for free, but they usually scam for larger items where people send them untracked.

Regardless of whether he is trying to scam you or not you will still lose a paypal chargeback. However, you can reclaim your loss via the Royal mail using your certificate (or proof) of posting, so you won't be out of pocket.

  • What does the negative feeback say on his account? Was it recent?

Check his details - you can request them from eBay to see if they match his paypal.

    Just do it here: http://search.ebay.co.uk/_W0QQtZvbQQsofindtypeZ9

Then ring the phone number and see if it is the acutal guy, then ask him to send a photo of the packet to your email and you will refund straight away.

How much money are we talking here? if its a low cost item, why would the guy try it on anyway? for a £1000 item I might think something is up, but not for a tenner.
  • tbh, its about a tenner, and i cant be bothered to deal with it.. i was just unsure how to go about it. i have decided to cut my losses and refund the guy, i just didnt appreciate him hounding me and dictating and telling me what to do.
  • thanks for all your advice and help!

You need the cooperation of the buyer to make a successful claim for non-delivery or damage.

Ask Royal Mail for a claim form for a damaged article and you'll need to fill it out and send to the buyer to have them confirm the details. If they refuse to cooperate then they are usually a scammer. Genuine buyers are usually happy to cooperate as they have nothing to hide.
