  • My husband was sold PPI in appx 1998/99 through Barclays even though he was self employed. When this was raised on your website I used your templates etc. to make a claim in October 2007. I had no joy with them as they said I should have read the policy and that I was given 30 days to cancel. When I told them I was going to the FOS they then advised me that the FSO could not deal with complaints if brought more than 6 years after the alleged breach of duty took place. It then did not seem to be worthwihile given that everyone else at the time was quoting 6 years for claiming. Recently however there appears to be the general concensus that there is not actual time limit to claim, just that it would be harder. I feel I have been misled once again by Barclays so is there anything I can do at this late stage. Any help would be appreciated.

    The FSA do have a 3 year/6 year rule that means you have 6 years from the commencement of the product or 3 years from being reasonably aware of a problem to make your complaint (the 3 year one being key).

    Most are not currently enforcing the 3/6 year rule as they have no basis to prove you were aware of an issue. Although in your case, they may well do if you formally complained previously. Plus, you only get 6 months after a a complaint income to take your case to the FOS.

  • Hi I have an endowment policy with my mortgage that has 3years to run it was fixed rate for19years. What are the chances I was sold a ppi because if I was I was not told .Secondly would Ihave been sold a ppi on the mortgage or the endowment or both?

    Quite strong. It is highly recommended for people that have the financial need for it to have MPPI. Still is even today. Why are you asking us what the chances are? Surely you know if you are paying it or not.

    Endowments cant have PPI on them. The mortgage can.

    My loan agreement accounts closed in June 2003 and August 2004.

    If you made a request under S78 of the consumer credit act (costing £1) then yes they are correct. That option ceases when the debt is repaid/account closed. You need to use the £10 data subject access request instead. However, there is no guarantee that documentation will still exist on closed accounts as it will be destroyed over time.

    Remember that you do not need the agreement to make a complaint.

    Even if you get the paperwork under the DSAR, that will only tell you if you had it or not. It wont tell you if you were mis-sold. What would your complaint reasons be as there is nothing wrong with having PPI. The whole issue is how it was sold or set up.

  • Hi looking for some advice. I bought a car in 2003 from Arnold Clark and it was financed with Northridge Finance. Paid all the finance of in 2006. As i am sure i had paid PPI on it, i wrote to Northridge asking for a copy of my agreement and the T&C's. I got a letter back to say they usually request a payment of £1 for this, which i am willing to pay but also added -

    'However as this argreement has now ended, under sections 77(3)(a), 78(3)(a) and 107(3)(1) of the Consumer Credit Act 1974 (as amended) we are under no obligation to provide details of this finance agreement.'

    Unsure what to do now. Are they telling me they will not be sending me a copy of my agreement and if so can they do this??

    Hi can anyone please help me, I have an MBNA card which I have not used for over three years now and the balance is zero. I went onto experian to see my report and noticed that it showed I am in arrers with MBNA, when I queried this with them they said that it's for PPI and that I needed to contact CPP as I have to take it up with them as they are a third party supplier. I do not want this, and do not need it, can anyone advise where I stand please? Do I have to pay this charge?
