PPI Reclaiming Discussion Part 5

crudoyle - just make a new post if you have a question, this is more of a general discussion, though you can post it in this topic if you wish
Sam Vimes' Boots Theory of Socioeconomic Unfairness:
People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

When I bought my property back in 2010, I was given Mortgage Payment Protection through Connells Estate Agents (also known as Wessex Gate). I have looked into the paperwork and it looks like it is payment protection if my husband and/or I became ill/unable to work.
Does anyone have any other information regarding this type of policy and whether anyone has claimed it back?
I believe we paid the monthly fee for at least three-four years.
I am new to this PPI claiming, so sorry if I am asking stupid questions.
Thanks in advance.
You can complain about the colour of the carpet in their office if you like. So, if you have a complaint, speak to them. It doesnt mean your complaint is valid or will be successful.
What do you think they have done wrong with the product they sold you? hi, I was advised I had had ppi on 2 credit cards. I knew nothing about (we have never and will never have ppi). I wrote to the bank in question and they said I had no case. I replied and again was told I had no case. I have asked them for any info they have in order for me to go to the ombudsmen and they have replied saying I need to pay £10 for them to see if they have any information they can send me. is this correct or do I go straight to the ombudsmen? thanks0

Hi,
A few years ago I put in a ppi claim with bank of Scotland. It was rejected as well as my husbands. Last year my husband received a letter saying they reviewed his account and he was actually due ppi back.
I had to call up last summer and state that I wanted it reopened as both my husband and I had been given the same story of getting ppi would mean a greater chance of being accepted.
I received just over £800 back once they reviewed my case again! Haven't been on here in a while but just thought I'd share that BoS have been re-reveiwing people's claims and maybe worth another call if you haven't got anywhere.LBM:01.12.14

If you had PPI it would have shown on every monthly statement you received, you cannot now say " I knew nothing about it " what reasons did you give for mis sell?.
Who advised you that you had this product, I take it you have no information regarding this account?.
When the bank said you had no case, what reason did they give?.
You can request all info they hold on you for £10 that is correct.0 -
Hi,I've just submitted a question but not sure if I put it in the correct forum? In 2011 Imade a claim to CAPITAL One about reclaiming PPI but was rejected. I had been paying it for over 7 years and felt it was mis-sold to me. After being rejected I was about to take it to the FOS but had a close family bereavement which left me in turmoil. I recently asked CAPITAL One to look at it again and sent them another claim form. I have today received a letter from them saying that they will not look at it again as its more than 6 months and the FOS will not help as its more than 6 months. Can anyone advise on whether it is worth going to the FOS?
Sometimes FOS will look at a complaint after the 6 months if you did not proceed for exceptional circumstances, I don't know about the bereavement after 4 years, may be a long shot but give them a call and ask and they will tell you if they will look at this now.0 -

If you had a balance on the card (rather than paying off in full every month) it would appear on every statement. The argument "I knew nothing about [it]" won't wash as you're just saying you never read your statements. If you paid off in full every month you can have PPI but never pay it.sally_edwards wrote: »I wrote to the bank in question and they said I had no case. I replied and again was told I had no case. If you want a copy of all your records you need to submit a DSAR which the bank can charge £10 for. This won't really do much apart from provide you statements which would show either you paid PPI (proving you should have known about it) or didn't pay PPI (so no case).
You only get back PPI premiums that you actually paid following a complaint so if you paid nothing then complaining won't get you anywhereSam Vimes' Boots Theory of Socioeconomic Unfairness:

The £10 DSAR request is correct if you are after info. However, they are within rights to not supply data in respect of a complaint or legal action where it could be viewed as a fishing expedition.
You dont need any info to go to the FOS. You make your case to the FOS (which should be the same as you made to the bank) and the FOS will communicate and will view the evidence available.
What was your real complaint (as complaining that you didnt know you had it when it appeared on your monthly statement is a weak complaint. You would be relying on another failure being identified)I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. I am looking for advice. I have successfully reclaimed PPI on 7 of my old credit cards.
However, my PPI claim to Nationwide Building Society was rejected although the circumstances were identical to the 7 successful claims.
I missed the 6 month period to complain to the Ombudsman but Nationwide agreed to reopen my complaint.
On review, they failed to uphold my complaint saying that I no longer had recourse to the Ombudsman - as I was outside the 6 month claim to the Ombudsman.
I wrote to the Ombudsman saying that this was one of 8 I had made which I had made which had failed admitting I had missed their 6 month window to complain to the Ombudsman.
The Ombudsman has now written back saying he has now tried twice to get Nationwide to reopen my complaint but Nationwide have twice refused as my case is out with the 6 months in which to complain to the Ombudsman.
Why then did Nationwide first agree to review my case - after the 6 month review period and through their "Tie-Up" team, without fairly offering me the opportunity to take my complaint to the Ombudsman. That doesn't seem fair?
I am convinced the case was one of mis-selling, just like all my 7 other successful complaints.
Has the Ombudsman in the interests of fairness not have powers to insist the nationwide reopen my complaint on the grounds of fairness and consistency?
Can you please advise of any further steps I can take before I write back to the Ombudsman and my case is closed?
Thanks.0 -

Unless the process was not followed properly or you have some exceptional reason why you missed the 6 months, then no.Sam Vimes' Boots Theory of Socioeconomic Unfairness:
