PPI Reclaiming Discussion Part 5

As I already pointed out to you, original credit agreements are not available after the account is closed. If the account is still ongoing you can request the agreement is sent (as an alternative to a full SAR).but strangely no original credit card agreement.
Nothing you listed would have been particularly useful in constructing a robust mis-selling complaint. All it did was prove that you had PPI, something you could easily have achieved by simply asking them directly.Oh and they also had records of all contacts with me since I applied for the credit card and none are related to PPI suitability at the point of sale.
What reasons did the Bank give for rejecting your complaint?0 -

The account is still open, although its a minor balance compared to the overall facility, but I'm sure my previous comments are indicative of the size of that.
Barclays have so far claimed it was online and therefore I had all the information about PPI at the time (they have only responded to the complaint I sent them, not the Egg "pass through").
As stated previously I originally claimed for the period of their tenure as it were, but I have subsequently found my credit agreement and the form has a pre-ticked PPI box on it. So I'll see what response I get from the Canada Square Operations passed complaint before going further. No point in troubling the ombudsman if they decide to uphold from the additional complaint criteria on that claim as opposed to the smaller set on the original Barclaycard complaint.
Can I ask if you have a particular interest in or experience with Barclays?
I can see there are many threads on the forum about their prevarication over what should be a fairly straightforward matter (especially considering they have just made a multi-billion £ provision on their accounts for PPI - or perhaps they just mitigating some corp tax, which they can then laud as extra profit next year if they manage to withhold payment of that provision?).0 -
No. My own PPI complaint was with HSBC.Can I ask if you have a particular interest in or experience with Barclays?
How much they've put aside to pay for upheld complaints has nothing to do with the validity (or lack of same) of your concerns. No Bank just automatically pays out in response to a PPI complaint-the PPI has to have been adjudged mis-sold.I can see there are many threads on the forum about their prevarication over what should be a fairly straightforward matter
If you signed this agreement, the fact that it was "pre-ticked" is irrelevant I'm afraid.I have subsequently found my credit agreement and the form has a pre-ticked PPI box on it.
It's only online sales where the box was pre-populated and it was impossible to continue without it that are deemed unfair by FOS. In your case, the online application (if you applied this way) will not have been part of any SAR information you received.0 -
Hi there I am new to this site and was wondering if anyone could advise on claiming back PPI.
In 2004 I took out a loan to purchase a car and was paying the loan back each month. Then I lost my job and everything went wrong. I went to speak to CAB and they were not very helpful. Anyway when I took out loan the bank sold me PPI insurance telling me that it covered unemployment but to my shock they did not pay out insurance, when the company I worked for went into liquidation and I lost my job. Of course I could not repay my loan or credit card which I had insurance for. So in the end the bank sent a debt company after me to get the money back, the weird thing is the debt company had all my details incorrect so I never ended up paying for anything but the bank had sold the debt to this company to get their money back. Anyhow I want to know can I claim back the money I paid for PPI insurance as it was never used as the bank told me after selling it to me that it was invalid to cover for unemployment. Also I now have a report on my credit file that I defaulted on loan despite me paying for the insurance to cover me for loss of employment....a double whammy!0 -
I am hoping someone can help me as I don't really understand all this PPI stuff.
I am planning on writing to Lloyds as I was a former Lloyds TSB customer and had the airmiles duo credit card. I didn't want a credit card I was just advised to get one after I was a victim of online fraud. I was in my early twenties at the time so didn't understand any of the jargon but got my card and that was that. No idea if PPI was on this account or not. Had the account for a few years before switching to Natwest in 2010.
I've also had several store cards over the years: Outfit and Next are two I remember having and I still have a New Look one. How would I know if I ever had PPI on these? With the Outfit and New Look ones it was the typical sales assistant saying I could save 20% if I got a card that day which tempted me to get both of those. I believe the Next one I got online.Saved: £1566.53/ £20000 -
I completely understand your frustration, it does feel like you're going round and round in circles sometimes doesn't it. As Moneyineptitude pointed out, yes the Financial Ombudsman go to the insurance company on your behalf, but by getting a third party involved who knew more about what they were doing than I did, I was given more reassurance and it felt a lot less stressful to know someone else was involved.
Thanks

After contacting RBS regarding PPI which I was sure that I had never taken out, I find that I have had five loans (going back to 1992) and two mortgages where PPI has been charged. I am at a total lose as to why I would have bought this. I have put in a claim for mis-selling due to the fact that I have no recollection of agreeing to it or requiring it. Can someone advise me if not knowing about it & not wanting it constitutes mis-selling?0
