    If the FOS has already made a ruling, then no you can't. If you are still in the window where you can choose to forward it to an actual ombudsman rather than an adjudicator, then you can try that.

    Hi all I am looking for some guidance if at all possible please.

    I currently have a case at the FOS which is related to an extremely old welcome finance loan (i know young and stupid!) however with welcome now being defunct the current status is that Aviva who were the underwriter for Welcome at this time have been sent information by the FOS to see if they were taking ownership of the claim, and I have been notified today that Aviva have accepted the ownership of this claim.

    Following this I have now been advised that this is now back to the assessment stage within the FOS and I am a little unsure of what this means following Aviva's acceptance of this claim?next steps from here and time scales that may now be involved or even if this shall be paid out at all can anyone advise ? many thanks in advance

    Aviva have accepted resonsibility, but the FOS stil have to judge whether or not it was missold. You'll have to wait and see.

    Only FOS and Aviva can answer questions like this. However, Aviva accepting liability does not mean they will definitely find in your favour although it's certainly a step in the right direction. As for timescales, there are none defined in such cases so you'll just have to be patient.

    Contact FOS directly if you want less generalised advice.

    Hi I have tried to look for my answer on this thread but have become cross eyed so hope someone can help?. My partner took out PPI with a mortgage and was told he had to have the insurance. He disclosed that he had had a brain tumour removed 2 years before not expecting a recurrence - this was all written on the documentation .It did grow back making him unable to work for year and the insurance wouldn't pay up even though he wasn't told that he wouldn't be able to claim.The insurance said it was a recurring illness so therefore wouldn't be accepted. We have completed the questionnaire from this site ( absolutely fantastic thank you). We received a reply today where the company (Brittania) admit at the time of signing they didn't provide advice or recommendations although he had a description of the insurance at the time. They admit as there was no requirement to provide advice or recommendations a full assessment of his needs wasn't carried out nor did the advisor check if the cover was suitable or not. They claim the adviser cant possibly go through every aspect of policy and my partner should take some responsibility for not ensuring he was covered himself. They admit that due to his disclosure of his operation it should have been referred to insurers for approval but it wasn't. They have offered a full refund with the 8% interest.
    My partner obviously takes some responsibility but he was told he had to have the insurance and it was worth absolutely nothing despite him being truthful then to find he couldn't claim. He kept paying each year as he thought he had to and only canceled it last year due to all the publicity.
    Can he ask the bank for compensation as well as a refund? It doesn't say in the letter that it is a final offer just the normal 1 month to decide if he wants to accept it
    Should he just go to the FO and hope they will find for compensation leaving him open to not getting anything at all?

    I doubt the bank will offer anything beyond the 8% they already are, but you can always ask.

  • Thanks Taff I don't know if he can expect compensation I just feel he took it out in good faith and as usual when you really need help when your ill there is little or nothing that can be done

    The 8% simple interest IS the "compensation". FOS certainly won't award anymore than the full redress already offered and I don't think your case has anymore merits than any other mis-sold insurance.
