    However, if there was a mixture of loans and credit cards, complete separate reclaim questionnaires from the loan ppi reclaiming to the credit card ppi reclaiming.

  • In 2005 I took out a PPI plan via Paymentshield when I took out a new mortgage.

    Both the mortgage and the PPI were sold to me by a third party broker, the one at the estate agent whom we purchased the house from.

    I have subsequently put in a PPI reclaim against Paymentshield. They have written back to me neither confirming nor rejecting my claim but stating I must contact the Mortgage Broker and levy the claim for misselling against them?

    The mortgage broker acted as an appointed representative so are Paymentshield correct or just playing a game in the hope that I go away?
  • I had a acknowledgement letter stating they aim to respond within 28 days. Then a second letter stating I would receive a response by 3rd May 2012. Low and behold, 3 days letter that claim was being upheld and 3 days after that my cheque :D

    I received my acknowledgement letter stating they will respond within 28 days, that was on 7 June. I called them today and they said that they're getting a letter out to me by 20 June and gave me a reference number. ?!?!? Hope its not a rejection!

  • Thank you very much for your help, I just have one more question, the Yorkshire Bank branch I used for the loan has closed, should I use another branch in a different area or should I post to the head office in Glasgow?

    In the instance you have described above the PPI may not have been started with the CC itself and therefore quite rightly it won't be ticked or requested on your CCA - often CC companies sell the PPI to customers when the credit card is activated (when you phone up to let them know you've recd the card). In these instances it is difficult to be able to prove or dis-prove (and I must stress I do not work for Cap One so not personally aware of their policies) that you did verbaly agree to the policy.

    If the PPI was started the same time as the card you have a straightforward case of mis-selling as you did not consent to the policy. However, if it was sold on 'activation' then you would have to be more careful - do you recall any of the conversation you had with the Cap one representative? Do you remember receiving any 'welcome' policy documents?
  • Seeing as I am new to this forum I would just like to take a brief minute to introduc myself.

    I work as a PPI caseworker for a well known bank (I can't say who or I'll be fired, shot, hacked to pieces and then fed to the wolves).

    Believe it or not our policy is that we ARE trying to give you your money back if you have been mis-sold, trying to find ways to uphold your complaint and not decline it. :T Afterall, if we decline your case and you then go to FOS the bank has to pay a set fee for every claim recd by the FOS irrespective of whether or not they overturn the complaint and so its easier (and cheaper) for the bank to do the work right the first time and not be charged this fee.

    Unfortunately people all too often just copy and paste irrelevant points from sites like these which actually has a detrimental effect on your claim (for instance, if you're complaining about a credit card then don't use points about single premiums or cost of insurance being added to the loan, because simply it isn't.) Or even worse - some people use PPI claim back compaines (CMCs) to do the work and they just throw every single standard complaint at us hoping one will stick :mad: instead of personally tailoring your complaint and helping your case.

    I'll help where I can, a little inside information can go a long way (although I am not claiming to be an expert with every banks' PPI case handling work streams)

    Sorry to hear you've had bad experiences. What you will usually find is that once the 8 week FOS time limit is breached then the company in question will pay you out regardless of whether you had a proper claim or not. Often there are legitimate cisrcumstacnes why a claim cannot be investigated within the staed timeframe and I know that many companies WILL try and contact you for further information about something you have noted or stated in your claim.

    I have started the process of re-claiming my PPI but was wondering if I will get anything.

    I have had several loans and fell into arrears with them all in 2006, I entered into a debt management scheme and paid the agreed amounts off each loan until June 2011, I then cancelled the debt management scheme and contacted all of my lenders, surprisingly they agreed for me to make partial settlement offers and close all of the accounts.

    I have checked my credit report and all accounts are showing as satisfied and I have confirmation from my lenders that the accounts have been closed, in total I had approx £15k wiped off my debts.

    My question is, if the lenders look into my claim will they refund me the PPI or use it to pay off the outstanding balances even tho the accounts have been partially settled and closed?

    My very best advice to anyone who wants to claim is..

    1) Do it yourself - you are the one with the answers to the riddle. And you won't be giving away a % of YOUR money to a third party.
    2) Fill in as much information as possible on the FOS questionnaire - this is YOUR BIG opportunity to present your case as to why you feel you were mis-sold the policy. If there's a big blank box for you to fill in, then do! This is the information that they are going to base their decision on. Provide as much detail as you can recall, this is your evidence - many companies won't (or can't) ask for proof of your personal circumstance at time of sale.
    3) Details of employee benefits - don't just say 'the usual' or 'sick pay'. Give details - how much full/ half sick pay?, And for how long? Death in service benefit?, redundancy pay?
    4) Did you have any other way of making payments? Any savings?(held with them or elsewhere?), Were these instant access? Were they saved for any particular purpose? (eg daughters wedding fund), Any existing insurance policies? Spouse/ family that could have helped out?
    5) Did you miss any payments? This isn't a trick question.. If you were struggling to make repayments near the beginning of the term then its likely they may be guilty of providing you with a policy you couldn't afford, or that stretched your finances.
    6) Be honest.. if you make an allegation that can be dis-proved then it will affect your credibility of the rest of your complaint.

    The more information you provide means they will be able to deal with your complaint more quickly without having to try and contact you be phone/ post to clarfiy details.
