So the advice I’m looking for is:Are the RBS calc’s correct? Are they right to deduct 20% Tax? If so what’s this for?
Calculations are fine given your circumstances and history of consolidation. They have deducted the 20% tax which HMRC would have eventually got around to regardless

They state in their letter regarding payment, “On receipt of signed declaration, we will arrange for payment to be made, subject to clearance of any arrears or indebtedness you may have with the Group”. I currently have a repayment plan in place to cover a previous 6 month arrears position, but it only has a balance of £1,000 remaining and I’ve continued to pay the standard monthly loan payment in addition to this plan. So can RBS use part of the offer money to clear the £1,000 arrears balance? And could they also use the remaining offer balance to clear my existing loan because I have two months of arrears still outstanding?
All arrears with this lender are going to be deducted from your redress.

I understand you don't want to get this wrong, but it really is just a case of accepting their offer or not.
Declining their offer will not succeed in increasing it.
  • Hi there,

I am currently pursuing a PPI claim on behalf of my elderly father, who initially took out a four year personal loan with HFC Bank in February 1992. This loan was then converted into an open ended Current Account Plus credit agreement in October 1992, which continued to run until September 2000!

Amazingly I managed to locate the original loan and PPI agreements my father signed at the time and these were submitted along with the claim.

HFC Bank have now responded that as the claim is more than six years after the loan was closed, they are unable to consider the claim unless bank statements showing the monthly repayments are forwarded. Needless to say, my father no longer has these statements nor is his bank, now Lloyds TSB was TSB, able to provide copies.

Can anyone out there advise if HFC Bank are entitled to ask for the bank statements in the first place when all of the agreements have been forwarded and, can they deny the claim if the bank statements are not forthcoming?

Any advice would be most gratefully received.

Yes, the loan is so old that unless you find evidence that your father paid the PPI the complaint is a non-starter. The agreements aren't evidence of actual payment, I'm afraid.

    Far too late.

Applied first in 7th March,,,then rejected both Master and Visa ppi mis sold claim few weeks ago letters dated 8th May and both letters were final decision letters of not uphelding my claim.

Today i received again another letter dated 18th may that at this stage we have not made any decision yet and taking time to decide and we will give you final decision soon.

I had already doubt that these people just playing our ppi claims and not taking serious and its strange that i received that letter today even i did not apply for reconsideration or went to FOS.

I dont know what should i have to do as they refused ppi claim and then later i receive leter about asking more time.

i'm having same problems as you with barclaycard, seems a common problem, after first 8 weeks i got letter of we need more time to look into your account......gave them more time.
after week after week of keeping intouch with them(7 weeks in total) got info from 7th week call that my claim had been rejected, and letter had been sent out to me comfirming reasons why, never recieved letter, asked why claim had been rejected.
was told "cant tell you,but will resend you prev letter"
4 days later got letter saying "they have still not made a decision, and will give final answer to claim by 2 july"
phoned them back on receiving this info to be told "yes still looking into acount" when i asked about prev call of "claim rejected" was told this was wrong, and will receive there final answer by 2 july.
expecting it to be rejected so off to the fos now,as know they just stringing me along as long as they can.
barclaycard are a joke,if we played the games they are with us we would end up being arrested for fraud for misleading people, but because there a bank and are goverment roll over to them,we get laughed in are faces while they keep are money when they conned us out of it.
good luck in your claim, but i'd save time and fos it.
  • I had a acknowledgement letter stating they aim to respond within 28 days. Then a second letter stating I would receive a response by 3rd May 2012. Low and behold, 3 days letter that claim was being upheld and 3 days after that my cheque :D

    Hi Taking Control

Good news well done, I sent my PPI claim in on 22 May, they received it Rec Del on 24 May, I received an acknowledgement yesterday dated 7 Jun (even though they say they acknowledge within 5 business days). Was just wondering how long between your acknowledgement letter and letter about claim being upheld. Also how old is your claim? Mine dates back to 1996 I think but I dont have the paperwork. Cant remember applying for PPI, certainly wasnt explained to me and just presumed I had to have it thats why its been on my ccard statement ever since! :)

The FOS cannot help you due to the year as Welcome were not regulated, you need to contact FOS and ask is it worth going after the insurer.

Received a 'Final Decision' letter from Welcome today rejecting my complaint ,saying that they weren't covered by the legislation prior to Feb 2003 , and that I would need to contact the insurer. However I only every dealt with the loan company , they sold the insurance to me (in fact told me it would help my application) , I was never given details of the insurer , or given a list of insurers/products to chose , so how can the insurer be held responsible when I only ever dealt with Welcome Finance ??? Sounds iffy to me.

Hi can anyone give me an info

Hi, im new at this, and not sure if this is where i should be posting this but I am wanting to try and claim back some PPI but not sure if its valid or who to apply to.
I took out my mortgage with northern rock but through a mortgage adviser, back in 2006 i also took out the PPI with the mortgage adviser through payment shield, i was informed that it was something that i had to do as my husband was selfemployed, one of those sales patters dont take it might not get the mortgage, risk loosing the house blah blah blah.
Looking at the policy schedule, my husband is self employed and the cover is for disability and unemployment?? am i right in thinking we wouldnt have been covered anyway?? Not really wanting to use a collection company i want to do it myself but not sure who i would apply to, to claim back as northern rock are no more and it was purchased through an adviser......please can someone shed some light.........:/

    3. As the four loans part of a consolidated loan chain, have they deducted the remaining balance (i.e. remaining balance of PPI loan less payments made) of the PPI Total when calculating the balance remaining for refinancing?
Loan 7 should have the whole PPI amount for that loan taken off to reduce the balance and the monthly payment reduced by the PPI monthly amount, they have given you the PPI you paid to date back with the interest plus the 8%.

You need to contact the insurer due to the year, ask Welcome who they are so that you can put the complaint into them.
Welcome were not regulated in 03, find out who the insurer was, if they come back and say " get lost" then FOS could help you with this.

How can the insurer be held responsible, as they didn't have any contact with me what so ever. Welcome decided what product was best for me (without giving any choice) and sold it to me.
