    Or 2 forms, one where a customer agreed to take it out verbally and signed for it and one where they didn't agree to it. Really need to get away from this idea it could be somehow forced on a customer or similar as it's not something you could ever prove.

    The second point that may be salient, is that the "your right to cancel" box (and text) on the second application form has been scribbled out (presumably by the bank's representative), but also has my signature against it, indicating that cancellation wasn't considered an option on this second loan.
    Not sure why your "Right to cancel" has been crossed through, but could that be because you ultimately decided not to proceed with PPI on the consolidated loan?
    As I said initially, though, you won't get a refund of this phantom PPI unless you can evidence payment of it...
  • Hello,
    With the August deadline approaching I would like to check and see if I have any PPI with previous lenders. Looking at my credit report I do not believe I have anything in the last 6 years.
    However when I first took out my first credit card(s) in around 2003/2005 I believe there may have been PPI charges that I was told had to be applied to the account. I believe this would have been with either Tesco or the Post Office, however I do not have any paperwork or account number information, 3 house moves and 15 years later the paperwork was shredded.
    Is this something I would be able to contact the companies about directly or has too much time passed with no account evidence myself to back up a complaint?

    You can phone them to ask but they may have destroyed any records or send a SAR.

  • Out of the blue I recently received a cheque from Bank of Scotland for £1200 for PPI refund related to Unfair Relationship Created. I had received refund originally from PPI from this Credit Card in 2010. Having read previously on here and elsewhere I believed that you could only claim unfair relationship if you have been turned down originally. As I had a car loan from same bank around same time and I had previously received PPI refund around 2010 as well should I write to them about unfair relationship for that product as well. Everything I read about Plevin seems not to have appliedin my case or am I am interpreting this wrongly?

    You have been very fortunate and received and additional payment that you were not entitled to, either due to poor record keeping, staff incompetence or the lenders poor understanding of the Plevin ruling and it’s associated requirements - this unlikely to be the case elsewhere I am afraid and I certainly wouldn’t spend that money too soon

    If you received a full refund of the PPI then you should contact them and double check this is correct (and get it in writing). If you cash the cheque and they realise the mistake, they will come back for the money and you will have to pay them.

  • Does anyone know why Ford Finance PPI web page says "To be eligible your finance agreement must have been active on or after 6th April 2008. Only PPI policies that were in place on or after this date are eligible to be considered."
    Is this correct? I thought it was from 2000

    I know why it says that. It is because those are the rules following the change of the law in 2006.

    Plevin comes about due to a change in section 140a of the consumer credit act 2006 (effective 2008). If the credit agreement your policy was linked to was still in force (i.e. you still owed money) then they have to consider it, even though it was taken out before the change. However, if the credit agreement was not in force (as you repaid the debt prior to April 08), then it never fell under the law change.

    The year 2000 doesnt come into it. There are other quirks in the dates as well (credit cards and mortgage PPI mainly).
