Excel Parking PCN

Hello,

I parked in the Iceland car park just went in quickly to get a few things was, couple of days letter got a PCN through the post for £60 as i did not pay and display, i have been shopping here for years now, i did have a Blue Badge displayed but it was not parked in the disabled bay. I looked on the internet people saying different things that they have no grounds to pursue you for ticket etc so phoned up Iceland Head office who confirmed it is a company they use and it has now been queryed and they will raise this with Excel Parking. Has anyone had a similar incident ? did they cancel the PCN ? cant belive for a gallon of milk ended up getting a silly fine :mad: guess will have to shop elsewhere now !

any advice would be appreciated.

    Ohhh you used the "F" word....naughty :rotfl:its not a fine, never can be and never will be :)

    What you have is an invitation to pay for their 2012 olympic tickets.....seriously you have noting to worry about, your excell ticket is the same as any other excel ticket thread on here, some do get cancelled if you complain to the shop and the shop give them grief....not many mind.

    If I were you carry on as you have been you have done nothing wrong, and they cant do diddly about it...oh and never contact excell or pay them a penny, have a read of this when they tried court on a few years ago...http://www.dailymail.co.uk/news/article-542355/Judge-quashes-300-parking-fine--set-frighten-intimidate-driver.html not quite the same senario as yours but you get the jist as to why they cant penalise you now I hope

  • Yes, Missy, fully endorse MB's advice, the "invoice" (it's not a fine as no private company has the power to fine anyone) is totally unenforceable and can safely be ignored. Good news is,

    1. If you do that, you will start to receive free toilet paper from Excel and their pathetic cronies;
    2. You can chuckle as you realise that their futile attempt to scam you is costing Excel money that you are not going to repay them.

    The bad news is the toilet paper will be the hard shiny sort, you may prefer soft and absorbent.

    After they send you a series of template letters and you don't reply they will cut their losses and push off for good.

    Or you could try talking the manager of Iceland into approaching them on your behalf, maybe by pointing out that is the last time you will ever shop with him if they have scammers in the car park.

    But, whatever you do, don't contact Excel directly. They will think you are taking their pathetic charge seriously, and you will just encourage them to pressure you more.

    It can be argued that Iceland has lost some money for you parking but not paying the displayed tariff, so if you parked up for 30 minutes and 30 minutes cost 50p, you would owe 50p.

    Ignore Excel and ignore Iceland

    Or you could try this by coupon mad , this is only advisable if you are fully confident this is is a scam, just edit it to your needs, like name of retailer etc





    Dear Sir/madam,
    Be advised that this is the only notice prior to a Small Claim that will be sent.

    A 'parking charge' (ref xxxxxx) was attached to a vehicle and I am the registered keeper and I have been sent the enclosed threatening letters.

    I must advise you that both the driver and the passenger are protected disabled persons under the Equality Act 2010 and are legally entitled to use when needed, a 'reasonable adjustment' such as a 'disabled bay' on private land.

    Parking Eye should have known that the car had disabled occupants from the disabled tax disc on the car. Of course, ignorance of disability law is no excuse for the enclosed unlawful threatening letters being sent to the registered keeper.

    This bullying of disabled people does not represent Asda in a good light at all - as a direct result of this, Asda have now lost the custom of our whole family who previously shopped at xxxxx store. Not only that, this is clearly harassment which is illegal.

    The car park signs which pretend that all legally-protected persons have to display a 'Blue Badge' are actually discriminatory. A genuinely disabled person quite simply does NOT need any permit to make use of this adjustment.

    I am sure that the Blue Badge scheme may seem 'convenient' for Parking Eye to pretend they can rely on, to make 'policing' of these bays nice and easy - but it isn't that simple. In fact it is an Equality Act breach for your signs to effectively suggest the bays are not a provision for ALL protected disabled people who have need of that adjustment.

    As you (Asda and Parking Eye) are now fully aware that the driver and passenger are disabled and entitled to park there, as the registered keeper of this car I expect to hear no more about this matter.

    Take notice that I will regard any further correspondence, save as may be required to litigate matters between us or to confirm that the matter is closed, from you, your agents or assigns as harassment within the terms of s.2(1) of the Protection from Harassment Act 1997. Harassment is also another Equality Act breach in its own right, and citing either/both Acts, I will also reserve the right to seek damages from you (Asda and Parking Eye who are jointly and severally liable for these unlawful actions).

    I now assume the matter is closed and sincerely hope that Asda takes action to stamp out this illegal practice by your agents.

    Just read comments for other post about Excel parking, my sis was saying she remembers seeing story about them on Watchdog, odd how you see this kind of stuff on BBC and never think it will end up happening to you : o ( when i spoke to lady at Head office she said i dont need to do anything about it and they will come back to me of to phone them back in 10 days.

    Surely they cant prove that i parked without a ticket the a warden did not physically look at my car and the camera would not have zoomed in that much to see clearly whether there was a ticket or not right ?

    One thing i dont understand is that the lady i spoke to said they use the Excel parking but then how are they scams ? confused really as surely Iceland should be doing something about them if they are scammers as everyone has pointed out on here.

    This mess is so not helping with me with my anxiety ended up getting a migraine and stuff had to lie down when i got the letter.

    Is everyone sure then they cant do nothing ? i know everyone says just to ignore the letter just worried about the weeks to follow, they cant send balliff or something can they ? i never been in such a position feel real uneasy about the whole thing :sad:

    What you need to realise, MissyKay, is that there is no point in quibbling about this and that, it is the entire ticket which can simply be ignored. No point in arguing about it!

    What often happens is that the retailer gets flim-flammed by the glossy presentation these people put up to try and persuade that they are a bona fide operation. They say they are in the British Parking Association, but that's got about as much legitimacy as saying that you can complain to Ali Baba about the 40 thieves. It has no lawful status it is just an informal guild composed by the scammer conpanies.

    The scam isn't actually illegal- sadly- though some of the harassing collection methods they use probably are.

    It simply relies upon widespread ignorance of the law, and a convincing impersonation of authority, when actually they have no more authority than you or I.

    And no, they will tell you about bailiffs and so on to frighten you into paying, because they have NO legal means of enforcing. There will NEVER be any bailiffs, it is a downright lie.

    I personally guarantee that if you ignore everything they WILL give up and go away; I should know; I have dumped off Excel and other scammers over 80 times, never paid a penny, and the "further action" has in every case been that they have disappeared.

    Its a scam because they try and impersonate an authority like the police or a council, whilst their business is not illegal, they do act illegally with the claims they make, there are countless times that they have been caught doing stuff that border on fraud. They are unregulated and there is no over sight of them. Their claims of circa £80-£100 for simple mistakes in car parks are effectively a penalty, which means that is illegal. Basically they hoodwink retailers and customers of these businesses, they are a leech off vehicle owners and drivers.

    Except that a lot of so-called "private land" are places where the public are invited to park. This includes supermarkets and retail parks where the parking is free. Nobody objects to pay a fee to park (if there is a fee), what we object to are the vastly inflated "charges" which are demanded if the motorists breaks one of the "rules", such as having a wheel touch a white line, or (even worse) staying a few minutes over the allotted time, even though that motorist might have spent hundreds of pounds in the store.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?
