    why would you,,cave in,,,when the letters start arriving??? (incidentally that is what parking spy et al want you to do),,its like this,,, you now owe every poster on here 1k,,otherwise we will send you letters,,,would you cave in then,,no,,i think not,,so relax,,its not a fine,,nothing can/will be done,,dont worry when the letters(threat o grams arrive) treat it as loo paper,,and having finished what you do with loo paper,then simply,,flush away.its a scam,,they want your money,, dont give it.full stop.

    I would not normally recommend writing to a PPC but the ferquency with which PE have produced these carelessly based cases that I agree that they should be pulled up short. Might I suggest the following amendment to give them FA's draft?
    Dear Sir,

    Re: (insert ticket number).

    I am in receipt of the above putative invoice.

    I deny any debt exists with regard to this matter and I will not, therefore, make any payment in respect of it in the absence of court judgment.

    I will also regard any further correspondence, save as may be required to litigate matters between us or to confirm that the matter is closed, from you, your agents or assigns as harassment within the terms of s.2(1) of the Protection from Harassment Act 1997. I also reserve the right to seek damages, as set out in s.3 of the cited Act from you, your agents or assigns and from your principal in this matter (the landowner, lessor or their agents).

    Please therefore issue proceedings immediately and in any event within the next 10 days or, in the absence of a letter confirming it, I shall assume the matter is closed.

    This may seem like stirring a hornet's nest but such is the OP's case that it would be a doosey at court. I have removed specific reference to the word "unwarranted" as that can be made better play of should a LBA become necessary. ;)
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

  • Thank you all. I will send one of the letters to Parking Eye and keep my fingers crossed. I am a bit reluctant to invite them to take me to court though! I have an excellent credit rating at present and wouldn't want to get slapped with a CCJ.

    I understand your reluctance but they have no case and you'd win hands down. I would put good money on them simply doing nothing more and that - ultimately - is the objective.

    You do not gain a CCJ simply because someone takes you to court. Firstly, they would have to sue you (in this case? they'd be foolish in the extreme), then you'd have to lose - and the chances of that in these circumstances are pretty slim indeed, then, and only then, you'd have to refuse or fail to pay any amount ordered by the court within 28 days. Pay within that period and there is no CCJ.

  • I too received a parking eye fine today. I entered Brockhole visitor centre ten minutes before it was shutting with my disabled mother who has a blue badge and she sat in the car whilst i popped in with the kids. Did not see signs about tickets and thought as shutting soon ok. Also thought blue badge holders did not need to pay. Fine for 60 pounds today. Was about to pay as frightened will charge further, court etc but having read posts like yours going to send the template letter and not pay. We are in this together! Let me know if you hear anything!

    Do not bother with the template letter. The advice surrounding that is now coming on for 3 years old and is out of date. Our standard advice is simply to ignore all of the letters and threats as ultimately they will simply go quiet. The only thing not to ignore would be court papers but based on current statistics the chances of that are slimmer than winning the Lotto.

    As HO87 says, don't pay, don't contact them, do nothing. You wouldn't reply to a scam e-mail telling them you think they are wrong so why do anything different here.

    Most (if not all) of us who post this advice have successfully ignored these scammers. Please join us.

    oggy,,ignore and all the junk mail from or on behalf of them,,its a scam,, no need to worry.nothing will/can happen to you.no crime committed.

    Send mine, Flowers! HO's is great, but this is the dumbos at Parking Eye we are dealing with! You have to keep it simple or they won't understand it! :rotfl::rotfl::rotfl:


    No need to keep your fingers crossed- this is a win/win for you. Either they slink off back to their hole in the ground, or they end up paying YOU money. Which are you hoping for?

    Oggy, if you are happy to simply ignore anything these jerkoffs will send you then just do nothing and wait for them to get tired and abandon the idea of scamming you. That saves you the price of a stamp- though personally, I don't stamp the envelope, and make them pay excess postage.
