Parking eye incorrect fine

Hello
I'm looking for a bit of advice about a parking fine I received today. Parking eye have fined me for going over the 3 hour parking limit in a retail park car park last week. I parked in the car park on 13/02 to visit the supermarket, left and went home. The next morning I used the car park again to go to the gym. Parking eye have only logged the initial entry and final exit from the car park, meaning they think I parked there for over 13 hours. This is completely wrong, but I cannot prove that I exited the car park well within the 3 hour time limit.
What should I do? Is it worth trying to appeal?
Thank you for any advice you can give me.

No point appealing as I can give you the results right now - after careful consideration of your appeal, we WANT your money, REFUSED!
The good news is that you can ignore parking cry as its unenforceable invoice inviting you to pay, don't accept the invite, don't communicate with them or their lousy agents. They do this well known scam of missing the time you left the first time, or entered the second time, they are basically trying to con you.
Basically do nothing and it will go away after a few junk mails and a phone call if they manage to find that.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -
This is a fairly normal trick for these scamming swindlers.
Yes, you do need to appeal.
To yourself. You can be the tribunal that hears the appeal! If you decide the charge was unfair, you can cancel it and pay nothing.
All you need do is to TOTALLY IGNORE each and every letter that you will be receiving in the next two or three months. These will contain a variety of threats from P.E., their tame puppy dog Roxburghe, and finally the non-existent solicitor Graham White who is really Roxburghe in disguise.
Take absolutely no notice as everything in the letters is untrue, they will NOT take you to court because they can't, and have never actually taken ANYONE to court.
Finally, when it dawns on them that you are not going to be intimidated by their garbage, they will give it up as a bad job and disappear for ever.
THIS ALWAYS HAPPENS if you determine the appeal yourself.
Alternatively you could appeal to Parking Eye (Not Recommended.)
You will receive a response stating that the ticket was correctly issued and you must pay it. THIS ALWAYS HAPPENS.
Of course you can still refuse to pay as described above. But there seems little point in wasting a stamp, so the "self-appeal" is the recommended route.
WHATEVER HAPPENS DON'T PAY, YOU DID NOTHING WRONG AND IT IS ALL A SCAM.0 -
Thank you to both of you
I know logically that their tactic will be try to scare me into paying, however the thought of a DCA chasing me is a bit worrying. Then again, I have done absolutely nothing wrong but I have no way to prove it.
Thanks again0 -
You don't have to prove it. Because they had absolutely no legal right to try and fine you in the first place! There is nothing frightening about a DCA if you realise that they have absolutely no more power to do anything that any other citizen cannot do. They are nothing. They cannot take you to court as they have no grounds for doing so. Do you imagine for a moment that if they had a case they could take to court, they would have to resort to cheap threats? They threaten because that is ALL they can do.
You can get rid of them by ignoring everything.
If you would rather get rid of them faster I can draft a template letter for you that will stop the process in its tracks. It's just that ignoring is easier and has the advantage that it costs THEM money.0 -

DCAs don't chase you or send the boys round! It's only some junk mail - and these letters are shown in the top thread along with a helpful Watchdog video with a solicitor holding a fake PCN with a pretty pic of a car on it, just like yours. Have you not seen it yet?
Just ignore them like we all do. Some posters here have drawers full of these rubbish DCA letters, all predicable trash, just play 'PPC snap' with each letter, matching it to the top thread pics, and file them.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If it makes you sleep easier Flowers just throw the mail away unopened or unread. Nothing will happen, and it will simply stop coming and you will never hear any more about it. I am a veteran of over 80 of these fake tickets, and have never paid one penny.
Indeed when one DCA carried on after I told them to stop, it was ME that sued THEM and I received substantial damages. That's how much I respect the pr*cks.0 -
Many thanks everyone. This forum really is invaluable!
I hear what you are all saying but fear I may cave in once the letters start. If I send the template letter from the main site, could it stop them contacting me further?
Thanks again0 -
Ok. Try sending them something like this: (Recorded delivery, so it stands out)
Dear Sir,
Reference: (insert ticket number).
I am in receipt of what purports to be an invoice in respect of a charge for parking.
I deny any form of indebtedness to you or to anyone else in regard to this matter. I will not, therefore, be making any payment to you or to anyone else.
Any further correspondence sent by yourselves, or any agents acting on your behalf, which continues to make unwarranted demands from myself, will be treated as being unlawful Harassment, contrary to Section 1 of the Protection from Harassment Act 1997; and damages under Section 3 of the stated Act will be sought from yourself, and any Agent acting on your behalf, and also from the owner of the Car Park referred to in your Charge notice.
No further warning will be issued.
I regard this correspondence as being terminated, other than to receive your confirmation that your file has been closed.
Yours faithfully,
xxxxxxxxxxxxxx
Send that, I doubt very much you will get any further letters, as they will realise you are NOT A MUG. If you do get anything come back and I will tell you how to issue a claim. Expect to get more than they are trying to scam you for, if they are silly enough to carry on.0 -

If you contact them it will have the opposite effect, your details will be transferred to the "mug who's fallen for the scam" file and as a consequence you'll end up getting more junk mail, not less.
As has been mentioned before Parking Eye can not issue parking fines, only the police and local authorities have that power. All Parking Eye can send you is a letter asking you to send them some money, a letter that has the same legal standing as a piece of toilet paper (but without the softness and absorbancy).
The second thing to bear in mind is that by law all a private company can seek to recover from you is a "reasonable pre-estimate of losses suffered". The loss the landowner (not Parking Eye) has suffered is £NIL so that's all they can legally seek to recover from you. Paking Eye are not going to go to court to try to recover £NIL so ignore their toilet paper and don't waste your time and effort trying to appeal to their better nature, they haven't got one.The fridge is empty, the walls are damp, there's no hot water
And I look like a tramp and tramps like us

If you read her original post, Andy, she hasn't even broken any of their "rules", it's the old double-entry scam.
I have never known any PPC continue after the above letter was sent. Hang on not quite correct- one did, but they paid me nearly a grand for doing so.
It's the ones that write in with a grovelling appeal that instantly get put in the "mugs" folder. The ones that say "eff off you are getting nothing" are marked "Not worth pursuit" -as I used to put on the file in my Civil Service days....0
