    Tesco are normally pretty helpful when I've taken things back after shopping online, i cant see why they wouldn't refund you. Having said that, I'd still eat it.

    There is some alarmingly ignorant advice being dished out on this thread from people who have no idea about either the practicality or the law.

    'Best Before' dates are indeed a guideline, even though it is compulsory to display them on most food items. It is not an offence to sell past the date, but if the food turns out to be harmful or unfit, the seller is responsible rather than the manufacturer.

    'Use By' dates are used on more perishable foods and it is a criminal offence to sell an item past its 'use by' date, or to change, cover or remove that date. It doesn't have to be unfit or harmful; that would be a separate offence.

    'Sell by' dates have not been used in the UK for around 25 years, except for on eggs.

    In the case described, I'd be surprised if Tesco refused to refund on the item, but would not be legally obliged to do so as the food was seemingly perfectly good. In practice, the advice to send it back to the manufacturer is probably best as they are likely to send vouchers or goodies. They are also likely to have words with the retailer about stocck control of their products.

    Can you point to the alarmingly ignorant advice. From what I can see no one has said the op has any rights and you info has already been posted, so you haven't added anything new.

    OK, you stated yourself that she was entitled to a refund. And the information I posted about the legal requirements had not been posted. So what on earth are you talking about?

    Try reading rather than spouting and you might learn something useful.:doh:

    i'd be seeking legal advice about taking tesco on. i'm sure any judge worth his salt can see this is worth a few thousand in compo for stress caused (the palpable stress that caused you to start a thread on here)
