If you got the phone/charger on contract its going to be Supply of Goods and Services rather than SoGA, although you haven't mentioned so not sure.

How would a phone, not provided as part of a contract or service be bound by those terms?

Out of interest, how long have you had it for? Chargers are accessories, and ony covered for 6 months usually.

If you are claiming under warranty this would be applicable, but given the OP has already run out of warranty, they are instead claiming under SOGA - which has UP to 6 years period within to dispute the quality of a product.

OP, can you understand that the shop need some sort of confirmation, from you, that the thing is inherently faulty.

The fact that it isn't working simply isn't good enough.

And why does the title of this thread imply that a mobile phone is broken?
they tested it in the shop
plus the phone came in a package and i have the right to return the whole package under breach of contract
the title is to help people who have broken phones and the staff has misled them by saying the warranty has run out and we wont fix it you have to buy a new one.. (illegal)
you right is to get the shop to
replace or repair or money back...:p

And again, this proves it is faulty, but as it is outside of the 6 months the onus is on you to prove the fault was inherent.

Uhhh, legislation to back this up?

There is nothing illegal in what you have been told. The title is misleading.

So why haven't you commented on your responsibility to prove that the fault is inherent?

For what? Its up to you to PROVE its inherent. End of.
  • I would still be interested to know how old it is... after all how long can you reasonably expect a charger to last?
Personally I wouldnt expect it to last for 6 years, but maybe thats just me?

Its important to stress its up to 6 years, not 6 years for everything.

If its a charger I would expect a couple of years, but thats just me - again, a charger is pretty much a disposable commodity which is easier and cheaper to replace in most cases.

I remember by the time I sold an old Nokia I had four chargers for that model as I kept forgetting it when I traveled.

Now I don't have that problem, its a USB lead and I can pickup a replacement for a quid - not even worth disputing with anyone...
