On a DMP - did you ignore letters from lenders??

    Not that I'm one to talk, but try and stay calm, make a list of all the things you need to ask your debt advisor and give them a ring ASAP on Monday morning.

    It says MAY....hope thats better for me....

    'If payment is not received by our Client within 14 days from receipt of this letter, court proceedings may be instigated against you without further reference. Once these have been issued, you may be liable for Court fees and Solicitors Costs incurred by our client.'

    However at the bottom of the letter it says in capital letters.....

    ' remember this is a formal demand prior to the commencement of legal proceedings and you are strongly urged to make immediate payment to avoid the above action'

    I guess on Monday my debt advisor can reassure me that Lloyds have been approached with my repayment offer, they should have been approached as it was set in motion 2 weeks ago...but I have no way of knowing this at this point, all trust in in debt advisor, and I dont know if my nerves will survive all weekend! :(

    FeeFeeDee...I have had letters like that from Lloyds over an unplanned overdraft that I havent yet started paying off. I got the threatening letter about a month ago, saying I had until 25th Jan to pay off full amount. I've not had another letter about that overdraft yet, or any court summons, and I have written to them regarding my financial situation, and heard nothing back! I have a big CC debt with them too, and have only just heard back from the letter that I wrote about that. The letter I have received from them re: CC says they wont accept my reduced payment offer and I need to ring them to reach an arrangement, but I'm hoping by the time I've done this next week, my DMP will be a bit further along and I won't have to worry about it too much longer anyway...

    Sorry if that seems rambly, but hope it helps...

    Is this letter from a solicitor or a debt collector pretending to be a solicitor? Have you received a default notice prior to this demand?

    What is the name of the solicitors?

    Speak to your debt advisor on Monday and, even if this is an actual, real demand, nothings going to happen for 14 days at least. If lloyds accept the DMP then the dogs will be called off.

    Don't let it ruin your Sunday, have a cup of coffee, relax and know your doing the right thing.

  • I got loads of these. We MAY do this, that or the other when I started my DMP. From court, to doorstep visits, 7 days to pay and so on. Even got 2 letters from Lloyds on the same day. 1 saying they accepted the plan, the other saying they would take me to court in 7 days time if I didn't settle in full.

    My advice is the same as everyone elses. IGNORE THEM. I also got worried and contacted Payplan multiple times for them just to tell me to chill out and just keep up the payment plan.

    These letters are just fired out at random in the vague hope that somebody, somewhere will worry enough to sell their car, or borrow cash from a relative to pay them off. They are just fishing.

    Seriously, DON'T PANIC. Just make it clear what you can pay and when and get on with it. These letters will last for a month or so probably and then will start to slow down. I still get the odd one now. I've just got a file for payplan and it goes straight in there.

    First of all A BIG thank you to you all for words of advice and support, and an apology for not replying sooner. Tbh, after I posed the question I was too scared to read your replies....which I know is really stupid, but I felt so sick with worry, I was scared that I'd read it was really bad news....anyway eventually I read them, then last night after some russian courage in the form of Mister Pierre Smirnoff...I googled the 'solicitors' name....

    Turns out, as I think eyeopener2 had suspected, they are the debt collection dept of Lloyds, under the name of SCM solicitors, I found that they have only 2 offices and 3 solicitors.

    So, I'm just off phone with my debt advisor. As I'm in Scotland I'm under DAS and everything is done electronically for me by her. By the tone of the letter I received it sounded like they hadnt had contact with anyone....this is true in a way, because all messages are sent to the insolvency teams (even tho its not insolvency Im applying for), not debt collection departments. So, IGNORE IT and all other letters....was the advice!

    Not one of my creditors have replied accepting my DPP (debt payment plan) but they now only have until 6th March to do so, if nothing is heard from them their agreement is deemed accepted. I have now been given the name of my payment distibutor and should hear from them shortly after the 6th as to my payment date. I will be relieved when the first payment has gone, because under DAS you dont make any token payments at all.....so as far as Lloyds go I havent paid them a bean for 4 months now....so I dont blame them for all the calls and letters I suppose.

    I've just felt everything was escalating and I was losing control because I was getting more and more letters and phonecalls. The debt advisor explained its because Id missed no payments with any company except Lloyds, so as I was seen as a good payer the minute I missed one they are right on my case. Understandable I guess, but God how I hate the sound of my telephone ringing!!
