interesting question, which hopefully someone can answer.
To the earlier poster......you got 10K direct from the CSA???? That would appear to be well in excess of the maladministration guidelines (linked to earlier in this thread and well worth a look). Can you tell me any more?
I have not sent anything to ICE yet, (NACSA told me the system had recently changed and that I should ring them before I write to them as there is a chance they might just refer me back to the CSA) the whole thing is just hard work and such a mental and emotional drain. Got to get the letter as close to word perfect as I can and dont want to miss anything out.
Re NACSA, I get a feeling that if I asked them questions they would be helpful but they never offered any assistance or much advice about the ICE case I am hoping to move forward, but that just seems like even more hard work lol, so am pretty much on my own. I did email a lawyer who quoted some exorbitant hourly rate. Could be that I would get compensated for legal fees, I most certainly could never receive enough compensation for my own time. Shocking that one govt agency can drive so many people to utter distraction!!0 -
I made a private arrangement with my daughters mother 20 years ago pre CSA at her request, she worked in legal and financial services at PA to director level. My daughter is 23.Last year I was contacted by the CSA and told I had been assessed as owing them £18,000. My ex partner made the arrangements, provided the paperwork which I signed. She took the money,I paid.Remortgage, further advance and loans supported by life insurance. The CSA took me to court, they gave the court a signed sworn affidavit that they had sent me details of the case in Feb 2010, the court hearing was on 19/9/2010. They posted the documents to me on the 18/9/2010 preventing me from attending and defending my self in any way. They thought that because they use bulk mail with a barcode not a dated franking mark I could not tell when it was posted.I took the envelope to the Croydon sorting office and got them to read it,and yes ,posted the day before the hearing. So from my point of view they are guilty of perjury and abuse of service. They should also be "out of time" to take me to court but they got away with it by failing to put my daughters date of birth on the documentation so no one would question it.I later found out that the paperwork was not even seen by a magistrate, just b"rubber stamped " by a court official. Now they are taking £500 plus per month that I cannot afford. My daughters mother is now a company director/secretary living in luxury in a Kent /Surrey border village.0

It wasnt really that news worthy. Basically I had to fight them for 6 years from 1998-2004 and they made mistake after mistake which meant CM payments for my daughter did not start to be collected until she was 6!!!! I have the original letter they sent me with the cheque somewhere, Ill try and dig it out so I can see what it says!
To me that £10k covered CM I should have been receiving from 1998-2004.
In 2010 They gave me £50 compo for accidently closing my case and taking 30 weeks to get it re-opened and payments coming back in!
I do find them utterly useless at times but I have no choice but to use them if I want to ensure my daughter has the standard of living she would have had if her father had stuck around!0 -
Ive been waiting 12 years and not received one penny. Ive had an official apology but thats all. My case worker is changed every few months but nobody tells me their name unless I phone and ask. The ex partner has now gone on sickness benefit to make it easier for himself. I find the CSA staff arrogant and rude, but I have no knowledge of how to get compensation.0

My complaint is still with ICE who phone me for a wee chummy chat every 6 weeks to let me know what is(n't) going on (sweet eh?) lol.
If I am not happy, my next stage is the parliamentary ombudsman or a tribunal...not sure which yet!0 -
Can i sue the CSA, I informed them that my ex parter was making plans to leave the country, by the time they got off their backsides he was gone, even went to the bother of telling me they had sent bailiffs to his address !! i told them why he has gone told you weeks ago, they said its a procedure they have to follow !! I am due nealy 15 thousand in arrears due to their incompetence0

Firstly, what is ICE?
I have joined NACSA which is a big step in my hopes that these ******s can't continue to walk over so many parents.
In brief, I am a NRP. My ex took me to CSA tribunal charging me with hiding earnings (bear in mind I'd paid over £100K for my two children by then and lent her £41k at this point!). i had to provide them (and so her too) with a ton of private personal financial information. I didn't give them everything to do with my business as I didn't have it and so they said 'OK, you didn't convince us of not hiding money so we will charge you £20k!. Guilty until proven innocent - just like real law! Its ridiculous as even when I produced it afterwards they said 'Too late'!! Too late for what? I didn't set time limits! Absolute <insert one of many obvious words here>...0 -
ICE is the Independent case examiner who is able to review decisions made by CSA and other divisions of the DWP.0

Just contacting the ICE when I spotted this on their site "We will only consider your complaint if the agency or business has told you, in writing or by phone, that you can bring your complaint to us."!
So i have to ask the CSA if I can get the case reassessed by the ICE? If they say no what happens?0 -

Generally I understand the final phase of the internal complaints procedure signposts ICE as the next stage.
You have to have to have gone through the internal complaints procedure first0
