I read this elsewhere on the forum:
The CSA have immunity from criminal liability because its a government agency. Also you cannot sue the CSA because you cannot sue the State.
Is this true?

i though that the only government dept that you could not sue was the M.O.D but i believe that status was took away from them, It was called royal exempt i think??0

Think the problem is no solicitor will take the CSA on (i think its been mentioned on here before). xThe feeling i got when i confirmed my place studying criminology at Exeter Uni was brilliant!!!!!

If you can sue the CSA then i will be first in line!!!! starting with the harassment route!!! Its unfair that just because they are a goverment organisation that they can make up and change their own rules to fit certain situations!! we are fighting a case with them and i will take it as far as i can go and if we win our case i will try and sue for all the trauma and unecessary suffering my family has gone through in the last 3 years by this shambles of an organisation!!0

I successfully managed to get an injunction against them for 12 months in October 2010 does that count...?0

The following articles lead me to believe that the CSA can in fact be sued for a variety of things. I have just about finished my letter to the ICE which is in excess of 2200 words (lol) and I have high expectations of Mr ICE. If, as I am led to understand it takes ICE 6 months to sort this out, the CSA will have been making my life hell for 2.5 years beyond any right that they have to be as I am the parent with care and have made no case with them to collect child support on my behalf. I am fairly convinced that the CSA have broken a number of laws in their dealings with me and I am waiting word from NACSA as to what they make of my case. Would be interested to know the maximum amount that gets paid out in compensation via ICE route

sorry if i sound daft but how did you manage that and what did it mean for them/you?
I applied for an injunction against a DEO, after the DEO expired, as it has a start date and an end date, and the fact that they removed nearly £4,000 from my wages in the 2 months after it expired.
So i went to the local county court and issued against them... It was granted, and they appealed it, and then argued they where a government agency etc etc, but i had there "company registration" paperwork to prove they where in fact registered as a business.
While i still had the injunction i moved to Norway and left my job in the UK, so i had no need for it anymore.
I was also claiming the overpayment to them, but in the period of having the injunction it was not paid so reduced the amount overpaid to next to nothing, and i left it as was...!!!0 -

myself and my partner have been hounded for 3 years to the point of an order for sale being applied for on our family home to pay a debt we argue we dont ow!!!, could you telll me if its the ICE we need to now go through as we have tried a solicitor and our MP to no avail. We are wanting to get our case to court of appeal to argue it, and have been sent a form by the enforement department of the CSA. but wondered how we go about ICE or what is the next step we go to for appealing etc any advice would be greatly appreciated.0
