  • There is a CSA booklet online - Special Payments Guide - on Maladministration, which defines the term and details under which circumstances they have to pay compensation.

    The sums payable are pretty insignificant though.

    (Tried to post the link, but as a new user, I cannot. The booklet is on the direct gov website, under "Complaining about the service you receive from the CSA".)
  • I attempted to sue the CSA for maladministration. In a nutshell my ex partner had an ex wife on CSA1 and they put me on CSA2. We didn't want to use them at all but it was forced upon us as if we didn't use them they would basically not of taken into account payments my ex made to me meaning he would have to pay more for 1st child. Anyway CSA1 computer would not talk to CSA2 computer so they took payment from my ex and gave it all to his ex wife on CSA1... FOR ALMOST 2 YEARS :eek::eek::eek:

    I phoned them Monthly, went right through the complaints procedure to the Ombudsman at the top, my ex was also trying as he was paying over £500 each month yet I was getting nothing. I instructed a Solicitor and CSA immediately admitted liability and paid up all I was owed which was over £2000 plus couple of hundred from special payments to cover costs.

    A lesser person than me would have broken, I have files of letters I wrote, spent hours, letter writing, phone calls, at the Solicitor... But I did it in the end! :T:T:T

    The joke is his ex wife was allowed to keep all the overpayment :(

    But she was moved onto CSA2 and i'm pleased to say we havent had any problems since :T

    not a lot, they told me to go to ICE and gave me the address......lol

    My case has been with ICE for nearly two years. This is after two Parliamentary Ombudsman reports and a judicial review. I think I will be going back to the Ombudsman after ICE finally reaches their conclusion.

    I wrote to the CSA in December 2003 regarding their Maladministration on my case. In May 2004 out of the blue I received an apology letter and a cheque for £10k.

    What has anyone got to lose if they have a beef get it down in writing or it will make you crazy!

    if you have an appeal ongoing through complaints and ice, ombudsman etc can any further action be taken? only asking as myself and my partner are trying to appeal our case but the csa are presently trying for 'order of sale' once our complaint goes in writing to the CSA will action in effect freeze until decisions are made?????
