unfairly being interviewed for benefit fraud

I think you have just answered your own question then.
They want to know where your additonal monies are coming from.
Just tell them. Why would you not want to tell them?0 -

no not in full, i have to pay a "top up" as they call it, towards my housing benefit of £160 per month0 -
Well if it is a compliance interview they can only ask you the question.
If its a PACE interview, then be prepared for evidence to show that you have a partner or any other income , any income must be declared and it is up to them to decide what is income and what is not.
The odd 50 pound from DAD if not in the maintenance agreement is not really permitable.
Its sounds like they are having you in for a living together, if its a pace interview they have a lot of powers to prove a partnership:
Access to bank accounts
Access to credit ref accounts
Access to DVLA
Access to employers payroll - for both of you.
Access to school details ie next of kin detail
Surveillance
access to utility bills
Access to check what mail goes to the house and in what name.
Just a few and the list is endless.
If its not a "pace" interview they wont ask you to much in case it comprimises there investigation, but will def attempt to unnerve you.if only life was a box of chocs0 -

i have never miss-led them, i told them at the last interview and many times before that he occasionally puts money into my bank for things like that or for the childrens sake. and as it is legal for him to do that i dont see how that could be a problem?0 -

thats if that is all they are implying, that me and him are still together i mean, i still dont understand about the phone line missunderstanding, when she was obviously lying about it. im just trying to guard myself from all angles...very confusing and scary!0 -
If the money can be classed as child maintenance then it is disregarded and shouldn't effect your benefits. Do you have a set maintenance arrangement with your ex or does he just give you money as and when the kids need things or you need a bit of help?0

im just totally paranoid about everything now, even phone records, can they have access to them? my children obviously have phone contact with him while he works away and im even thinking of stopping that until this investigation is over in case they use that against me,
and he is due leave shortly so will obviously want to come over and see the kids and nothing would stop me putting a stop to that, but it does make me feel uneasy0 -

no never really had a proper maintenance arrangment because he works on a self employed basis so it really is just dribs and drabs when he is working. there has been really long periods of time when he wasnt working and couldnt afford to give me anything.0 -
Does he have his own address where he is registered on the electoral role, pays rent?0

I'm sure if this is the reason it will all be fine then. It might be useful if you can look back what he has paid in when and just tell them it's child maintenance.0
