I see posts about people with obviously hopeless cases being encouraged to continue by FOS advisers on here all the time. Having said that, I also see FOS adjudicators upholding some surprisingly weak cases too.There is an institutional issue within FOS of consumer facing advisers being unable to say anything to the consumer that may give the otherwise correct impression that they haven't got a hope in hell of getting a successful outcome.
This leads to unrealistic expectations of what the likely outcomes will be, and further prolongs an already painfully drawn out process.0 -
When you say "officially" told you do you mean your adjudicator suggested that they will try Pinnacle?
This is the answer I had
"if you are confirming that this is the case then I will set the complaint up against them and we can go from there."

Unfortunately, FOS does seem to fall into that trap. Other posts on this site indicate that they unfairly falsely raise consumers hopes by sending them off to insurers who have no liability.
There is one technical argument which ought to work against an insurer (but FOS does not yet seem to have recognised).
Finally, if lynda1685 has taken a business to court over her dispute with it, FOS will not get involved.0 -
from what i have read nobody was putting you off, unless you detail your reasons for a mis-sell then its difficult to advise you.
also being vague leads to bad advice and dosnt help other people in your situation who could use the same advice

I sent the F O S 2 very thick A4 files with all the details about my complaint including the Court outcome.
The FOS are fully aware of my Case and have already informed me that my detailed explanation of the Court case would not effect my claim.
FOS say here "We do not allow a conflict, or potential conflict, to arise between our findings and those of a court."

They cannot do that. The complaint has to first go to the firm concerned. So the most FOS can do is send a letter to Cardif Pinnacle and ask them to respond at this stage.
The likely response will be to the effect that "the policy was not sold by us so it cannot have been missold by us".
Where you might make progress is arguing a breach of the GISC code by accepting business from an intermediary that did not also subscribe to it.0 -

The reason I asked was that you gave no reason to suppose you had a genuine complaint.
If somebody else guided you then either they had access to information you never provided to me or they guessed and were lucky.0 -
Hi iwas new to the site cut me some slack its not good to accuse someone of not helping others in the same situation, i didnt get a chance to be less vauge or to really answer thanksfrom what i have read nobody was putting you off, unless you detail your reasons for a mis-sell then its difficult to advise you.
