Just to inform those that may have been interested in the problem I had with the FOS
They had made a mistake and got the info on letters crossed.
F O S now officially told me that action on my complaint will now be taken on Cardiff Pinnacle Insurance (Pinnacle Insurance)0 -

When you say "officially" told you do you mean your adjudicator suggested that they will try Pinnacle? The FOS know that a small number of cases do exist where the insurer carries the liability. However, the FOS doesnt appear to know when that is the case or not. So, it tells everyone it will try the insurer. Most will be rebuked by the insurer telling you that they have no liability. A small number will have liability and the complaint will be considered by them.I am an Independent Financial Adviser (IFA). There is an institutional issue within FOS of consumer facing advisers being unable to say anything to the consumer that may give the otherwise correct impression that they haven't got a hope in hell of getting a successful outcome.
This leads to unrealistic expectations of what the likely outcomes will be, and further prolongs an already painfully drawn out process.0 -
I will make a couple of points here.
Firstly, I asked Podium why they believed it was missold because they said that it had been but given no grounds on which that assertion was based.
A person can believe that they have been missold but it does not mean they have been any more than a belief that they are the Honey Monster means they really are.
If all you want is people to tell you that you have been treated badly by the nasty bank and you are entitled to lots of money, rather than a fair opinion then may I respectfully suggest that this is not the forum for you.
Unfortunately, FOS does seem to fall into that trap. Other posts on this site indicate that they unfairly falsely raise consumers hopes by sending them off to insurers who have no liability.
There is one technical argument which ought to work against an insurer (but FOS does not yet seem to have recognised).
Finally, if lynda1685 has taken a business to court over her dispute with it, FOS will not get involved.0 -
I sent the F O S 2 very thick A4 files with all the details about my complaint including the Court outcome.
The FOS are fully aware of my Case and have already informed me that my detailed explanation of the Court case would not effect my claim.
When you say "officially" told you do you mean your adjudicator suggested that they will try Pinnacle?
This is the answer I had
"if you are confirming that this is the case then I will set the complaint up against them and we can go from there."0
