  • I know the answer to this but am reluctant to post as it is a grey area with little case law if your income is low go to a Solicitor to see if you qualify for Public Funding. I would just say one thing an Order can include child maintenance!!

    Thanks, I have tried to get legal aid but have been told by the solicitor that I do not qualify by a very small amount...we are talking a few pounds here. Looks like I will just have to do my best my court.
  • If we look back through the thread then you will see that I was only reiterating what Zara33 had said, people shouldnt rely on child support, which was my main point.
    I wasn't trying to be nasty or vindictive,and I never made any assumptions when I posted that comment.
    I apologise MXW for making judgements on you from something you later posted but I was very angry at what Zara33 had posted.

    I sent a PM to Zara33 as I didnt want to get into a slanging match on here as I didnt think it would benefit MXW any. And also because I had already stated I wasn't going to get involved in the discussion any longer.
    What I said wasn't much different to what you said, but for some reason I was being nasty.:rolleyes:

    I would be grateful for more info regarding Court orders and child maintenance. As far as I understand it there are only very minimal circumstances where this can apply such as child being disabled, child being over 19 and being at university for example. As for bog standard maintenance it has to be via the CSA if is is to be legally binding. There are temporary provisions that can be made provided that both parties agree, but that doesn't preclude anybody from going to the CSA at a later date.

    Further legal info would be extremely useful as I would dearly love to go to the Courts to get my ex to pay!
  • It was never my intention to belittle anybody, I only intended to be supportive and show MXW that it could be done. She may not get her problem sorted as we all know from reading these boards that what should happen and what actually does are 2 different things. I was merely trying to be supportive in showing her that it isn't the end of the world.It will be hard but she still has her kids and will still love them.
    I have already apologised for the statement I made later and have said it was wrong to say but I said it in anger.
    Can we leave it please you have stressed your point, I've stressed mine.

    Seems we have moved away from my original question. Does anyone have any idea how the courts work out whether a person has enough disposable income to pay his child support, based on if he was on benefits and his situation as it is now? What do they class as an outgoing? Would the child support be an essential outgoing as opposed to a loan for a car etc? Any advise would be welcomed.
