Notice of Intended Prosecution advise

Hi Experts,

Need some advise, I have received NIP for overspeeding in 30mph limit at 40 mph. I am not sure how it happened but normally I keep a close eye on the speed. I sold the car next day(30th Jan) and don't have with me now, but the day it happened it was myself driving it, I would accept that I was the driver that time, but have few more worries, as I planned to sale the car, my insurance ran out 25th Jan, I didn't bother to renew it, my mistake, also, I had 2 years provisional license only so was driving on it, now Police has send me as of now letter asking to confirm driver at time of offence, would they also check the car was insured when offence occurred or would they just send me 60 pound FPN(Fixed Penalty Notice) and 3 points on driving license, Please see I accept it was my fault just thinking best way to minimize penalty and how do I proceed ahead, any advise would be really appreciated.

Thanks.

If you were driving on a provisional it'll be more than 3 points. You'll be looking at a court appearance and a criminal record for driving without a valid licence. Plus the insurance issue which will be an automatic invalidation of a policy even if you had one at the time.

In short, you're the reason my premiums have gone up and continue to go up. You're also the reason I can no longer tax our spare car because we're now forced to SORN it unless its insured full time.

I hope they throw the book at you.
  • If you were to get done for all 3 offences you would only get points for the no insurance 6-8.send cal the nip naming yourself and see what they offer.
  • As above. All you can do is send it back, plan for the worst and hope for the best. I hope you've learned a lesson.

Unless they throw the book at him then sadly I don't think this'll be the case.

    Too true.

@spoiled_genius: The insurance is one thing, but would you mind telling me why you feel its ok to go around driving on a provisional licence? - You're not a qualified driver and haven't had to learn about the hazards the rest of us face.

    Why do you do it?
  • If you really do not a full driving licence then I hope a big book is thrown at you. Your username says allot.

Have you got a full licence?

That's what he said. Speeding whilst driving without insurance or a full driving licence. I think his other posts says it all really.
  • To be honest I'd be surprised if they'd do any additional checks, most of the time these NIPs are processed by an office full of admin staff who'll just deal with the fine ASAP. I reckon the best bet is to Just post the form with payment for the fine rather than risk getting yourself into more trouble by coming up with some dodgy scheme.
  • I think the OP means that it is less than 2 years since passing the driving test. Meaning the OP can only tot up 6 points before losing the licence and having to retake the test.

Even so, driving without insurance is a no no and I hope the OP gets what is coming.

He will have to send his licence off so they will notice it is only a provisional
