    Thats what they sent me, i posted it earlier in the thread. i need to know what i can say / do to get them to leave me the hell alone

    Still going round in circles with this company- but they released ONE bit of information in their most recent letter. I'll show below.

    Dear Mr (Name)

    Debt Purchased From: Shop Direct Financial Services
    Account No. (number here)
    Balance $419.18

    Further to your recent correspondence and in order to process your communication further, we would request you provide the following information by 23 June 12 to assist us in resolving this matter.

    (A box with a TICK) - Proof of Residence at time this account was opened 03-12-2005

    Your assistance would be greatly appreciated. Please note that this is not a demand byt a request.

    Honestly i dont even know what this letter is asking me for, where i was living 6 years ago, that's not anyones business but mine?

    Well, I know I wouldn't be able to prove where I was living in 2005! lol

    Personally, I'd just ignore it.

    Ok so i took your advice and ignored them, now i get this.

    Together with my team, it is my responsibility to progress you account through the litigation process, but also to assist and inform you on any query or question you may have.

  • If it's not your debt then ignore it!!! they can't pursue what isn't yours in the first place.....

    In response to your letter of <date> I would remind you in categoric terms that the debt you are alleging is nothing to do with me and the matter will be robustly defended. Further, you are instructed that there will be no negotiation of any payment towards this alleged debt.

    If you are minded to pursue this matter further, I require you to forward
    • all your proof of the existence of this debt,
    • all your proof of your assertion that I am the debtor you seek,
    • the complete record of the conduct of this account
    • all contracts and agreements on which the alleged debt is based
    • all correspondence with the alleged debtor prior to it being assigned to yourselves.
    This material must include all information which you intend to lay before a court - in accordance with pre action protocols.

    Short of taking the matter forward as given above, you are instructed to cease and desist from all further collection activity on this alleged debt. Should you fail to heed this instruction, your actions will be dealt with as harassment and also as reportable to the OFT.

    In the end i just gave up, i got so bored of the back n forth with this company, i just stopped replying and would you believe it, so did they!

    Since june i have heard nothing more from them. This pleases me :)

    Moral of the story if they don't have a leg to stand on, just ignore them. If they had proof they would of done something a lot sooner.

  • my mum has had two letters almost identical to this. From capquest saying they have bought the debt from from shop direct finance. The amount is over £100. My mum has NEVER EVER had a credit card, loan, store card, catalogue account, contract mobile, nothing. She has never been in debt in her life. She is old school and believes if you can't afford it you can't have it. She only has a bank savings account, and her wages get paid into her post office account. (No overdrafts) She is worried sick about this letter and when she tries to phone, it just rings and rings and no one answers. We can't understand where on earth this debt has come from ??
