But you say the car gearbox is knackered and your case for rejection is that it is faulty. So if he reassembles and gives the car back you still have a U/S car. Then if you go the rejection route which is all you can you must stop driving it, i.e. lay the car up as if not you have accepted it. Simples!!!0

point taken,but her complaint was it clunky but she,d get used to it,i cant drive at the moment so never checked ok.in the last 4 weeks it deteriorated rapidly and first went back for inspection 3 weeks ago.we arent all mechanically minded
Modern boxes aren't clunky so the evidence is that you or your wife knew and did nothing about it. Therefore it can easily be argued in a court that your negligence to report it was a major contributory factor to it's ultimate failure.0 -

He's offered to repair. He could of course put a second hand unit in and be within his rights. All he has to do is return the car to the condition of a 51K mileage car. Your box is halfway through it's intended life and one third through it's design life.
Believe me, take the offer whilst it's still on the table as it will end in tears.0 -

ok im starting to get convinced here that maybe right thing to do is cough up...but heres a little more background info thats makin me loathe to do so.2 weeks after getting it ,we took it back for an aircon=heater failure and guess which was not covered by the warranty i had paid for so that was covered partly by renault £600 it has had a couple of other niggly faults that were reported in the first month but all rejected under warranty,at this point i knew nothing about sale of good act,but these cxxxs obviously did and did naff all for me.the sales man who sold us the warranty told us it would cover everything except bodywork and tyres.we never received the policy till 3 weeks after and never checked it till this problem arose.the warranty he described to us was a platinum one which i now know couldnt ber sold to us because age of car.Tetley_the_Cat wrote: »He's offered to repair. Why are you directing the O/P to that thread - its a 'kick a motor trader' thread and those keyboard warriors there did nothing to help the O/P in that thread, and there doesnt appear to have been a positive outcome for the O/P there either?
What's the outcome?
So far all I can see is what action needs to be taken.0 -
If its the 1.6 VVT then i would also negotiate the dephaser replacement aslong as camblet/aux belt change at the same time if its on 53k / over 6 yrs old.
I would consider both gearbox and service items done at the same time as half the engine will be apart anyhow.0
