Hi there,
I have recently bought a brand new iPhone on contract from a major UK telecoms company. The supplier of the telephone is a third party phone provider similar to, for example, Carphone Warehouse.
Basically, I have received two iPhones, when I ordered only one.
Legally speaking, (forget morality...) what are my rights when it comes to the extra phone? Personally, I'd like to keep it and give it to my partner, but I dont want to break the law... :A
I wondered what the official/legal stance would be.
Is it a "bank error in my favour" , so to speak?

Even bank errors in your favour usually need to be returned once they realise. You clearly expected one phone so you know it's an error, you cna;t say you didn't realise.
There will be a record of the serial no and where it was sent to, and at somepoint they will likely tied them up.
Ask yourself this, do you want a £500 bill in a few months when they realise. Yes there is a chance they may not but prepare for the worst case.0 -

if thers no mention of the 2nd one anywhere on paperwork, keep hold of. not your problem to sort their stock control out.0 -
keep it for now but if they ever ask forit back you can give it back
did it say on the order you signed for that there were 2 in the package?What goes around-comes around0 -
Make sure you only got one sim card and one phone number. If you got 2 sim cards then you could get 2 phone bills, ie they signed you up twice.
Check the website again and see what it says if you were to sign up again - it could be a freebie, as mentioned above, or it could be an error which they might notice and try to resolve by asking for the phone back...
Legally and morally, it depends if they messed up. If they did, it's not yours to keep and so they could and might just ask for it back.Having fun trying to save money without going over the top and living on budget food all the time...0
