Morning all . We have arelatively new Tv that suddenly has no picture (just sound). We bought it from Comet 15 months ago. I didnt buy any extended warranty , so Im assuming that there is a 12 month warranty max on this TV.

I am just trying to pre-arm myself with as much information before I call or visit them. I am happy to get the tv repaired, so dont want a refund. ( I have the receipt - paid debit card by the looks).

I have read some of the articles on her e, and some quote 'resonable' amount of time. 15 months doesnt seem reasonable, but I always worry when something like that is subjective rather than a set length of time.
Can I qoute the 'Sale of Goods' and state its not a resonable amount of time for it to break ?
Im sure they are strictly told what to say , so i feel a dispute coming on :(

Any advice is welcome . Thanks .

Because 15 months has passed, they may require you to "prove" the fault was inherent.

However, before gearing up for a battle....just try being polite and explain to them what has happened. You are more likely to get a good result doing this than going in talking about your rights.

If they refuse, you could then say that you don't believe 15 months to be a reasonable length of time for a tv of this spec/price to last and that you're not asking for a replacement or refund, just a repair under the Sale of Goods Act.

If they still refuse, ask specifically what proof they require that the fault is inherent in order to obtain a remedy. It will likely be a independent report (and the cost of this will be refundable if found in your favour).

But try being nice and polite first and you might avoid all the hassle of the report etc :) All too often people read on these forums about people having trouble with companies. I've seen many a thread about argos, comet etc but yet....my local store have always been great! So have a little faith that good customer service does exist until they prove its misplaced faith :D

I think Currys operate a system whereby they charge a fee to have it inspected. If the fault is inherent and therefore eligible fo a repair under Sales of Goods Act they refund this fee. If though they prove it to be down the W&T or misuse then they don't. (or is that Comet?)

In summary though if the fault is inherent, you are entitled to a remedy (repair, refund or replcement) - effectively retailers choice. So they will likely repair it. If they refuse to help, you may need to get your own independent report to prove this, but they should reimburse you the cost of the report.

Its Comet the OP bought from.

  • What make and model is the TV? I'm in the market to buy a new one in the next few weeks, so I need to know what ones to avoid.

That is indeed part of Currys/PcWorld's process, though they do have a reference list of models of affected items with known inherent faults and sometimes will instead direct the customer to the store with the item (if it's small or if the customer doesn't mind taking the item back) for the KnowHow staff to double-check it's not obviously accidental damage and if OK the Knowhow Staff will call the call centre back to get a a BACS transfer done for the customer without a inspection fee being carried out.

But the OP is talking about Comet, so point is moot.

Any TV can have a fault. If you base your decision on what not to buy on simply because someone has posted a thread on their faulty model then I don't think you'll be buying one anytime soon. ;) Also, not really relevant to the OP's problem.

Update ... spent 10 mins on hold to the Comet helpline (at 10p a minute )
Got thru to a techie who said its areasonable time to still return it for repair, and to speak to the store.

Just spoke to the store , and suprise suprise, the 'helpdesk' just said its over 12 months go away. "thats our poilcy". I told him about the sale of goods and reasonable time etc , but he was just programmed to get rid of me.

Im happy to go instore and argue the toss, but Im sure they face people every day with this , so I need to pre-armed with exactly what I should say , and what the England law is , and not what Comet decide .

(Its a 19 inch LCD Hitachi tv , and wasnt cheap at £199, but has good sound compared to most - just no picture !).

    Thanks.

Okay , Ive take the stress free option. Comet is about 10 miles away , so rather than go thru the pain of getting there in my own time, arguing, then at best them fixing it for some cost, Ive just taken it to a locat tv shop.

I feel defeated ... but all my energy is going on our fight to get some decent compensation for my wife after she was hit by another driver.

Well, Mr TV repair shop man recreated the fault , but cant fix it.
He says the parts are so entwined and enclosed , he may not be able to even get the parts , and probably over £100 anyway.

So its back to Comet to argue (I mean discuss).

So , guys, what can I quote to try and get the item fixed by them ? Most of the guides on here say go to the retailer and not manufacturer
