Park car in drive with no insurance?

Hello,
Hope someone can help. I have a car taxed and moted! and my insurance runs out on the 5th and I asked my dad to get my insurance for it and hes made it with another company but for some reason he got it to start on the 7th not the 5th of February!!!
Anyhow, will this cause any problems, it is illegal for those 2 days? It will be parked in our private drive way for those 2 days.

It's a grey area. Not really illegal, but it is a technical infringement, for which you can be given a penalty notice. However, as someone has said, the system doesn't work that quickly so you'll be fine.
But, as someone has also said, what if it is stole, especially if it is a newish car worth a lot of money. You could remove the battery for those two days, most thieves don't carry a spare battery and you'd probably hear a tow truck hitching it up.0 -

It is not a grey area, it is an offence contrary to s.144A, Road Traffic Act 1988. But as has been said, it doesn't work that quickly, certainly not for two days.0 -
^^^^ agree, nothing grey about it. In reality though its highly unlikely anything will happen due to it only being two days.
TBH though why you messing about worrying about this or that just phone the insurers and ask them to change the start date.Everyones opinion is the most important.....no wonder nothing is ever agreed on.0 -
The first communication will be the option to either sorn it or insure it.
And it'll take more than 2 days to send you that, so you'll be fine.
You also have time to send the tax disk back from the 5th, if you had decided to take it of the road, so again you have at least two weeks for the dvla to action that before they even consider sending the first letter.0 -

It certainly is a grey area. It is similar to the fact that if you SORN a car, you are meant to re-SORN it every year now. I have a car that I SORNed three years ago, but only did it the first year (it remains off road but I don't fill in new paperwork each year).
For that, they have tried to 'fine' me. The DVLA don't do it, they hand it out to a private company, to which I say to them, "I have no contract with you, p1ss off, you are a private limited company and I have signed no contract with you". Then they go away and stop bothering you.
It is very much a grey area, which is why the DVLA don't try to prosecute you but hand it over to a firm of solicitors and many people pay up. To anyone doubting me, I can say hand on my heart, that I've had the DVLA legal company try to chase me and 'fine' me, for not re-SORNing my car and have told them to go away and no action has been taken against me and I know of one other person who has done the same.
So yes, it is a bloody grey area and the law is very unclear on it, which is why the DVLA don't get the magistrates to summon you.0 -
The fact that DVLA may not take further action in some cases does not make it a grey area, the legislation is quite clear.
There are threads on internet forums where DVLA have made court claims in respect of SORN and vehicle licences.
Just because they have not taken any further action against you doesn't mean that the won't take action against someone else.
The difference could be what they are claiming - the Late Licensing Penalty for late or failure to re-licence or SORN which is a civil matter, or the Failure to meet the insurance requirements which is a criminal matter.0 -
touch on a point here.
unless you renew your car wont show on the MID as insured when purchasing another policy with a new company, it can take a few days for the MID database to update the vehicle records of recently purchased insurance.
now under new rules technically those cars who show as not insured must declair sorn and keep off the road, and send the tax back or youll be liable for a rine.
for a meesly two days, i doubt the DVLA will bother, the likely hood in contesting the fine and winning would be too great especially when you can argue there was a mistake made by the insurers and out of your control.
just keep the tax in it and wait till your insurance is running to drive it.0 -
