PCN - 2nd Appeal Turned Down - What Next?

    pmsl it is nice to get a different perspective of things ;) though I am still convinced that most councils operate in a way to issue as many PCNs as possible, you have to ask though about the number of successful cases to the motorist that the adjudicator gives, if he could give costs to the motorist would so many spurious PCNs be issued ?
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    You could be forgiven for thinking so mate but where I used to work most of the staff used to spend as much of the day as possible skivving in cafes etc. They didn't like going out issuing tickets and just used to come back in saying it was a quiet day out there etc.

    The boss being a lemon believed every word of it officially (unoffically he knew full well how the game worked).

    As for the different perspective, I'm honest. If I think you've got little chance of a successful appeal I'll tell you but likewise if I see a chance and something you can use in your appeal I'll tell you. I've always been honest when I was out on street and I had very few people give me any grief and very few would ever complain about my PCN, service or anything else.

    Parkeon P&D machines can issue test tickets to CEOs to confirm they're working ok. It contains the machine number, time, date and any number plate numbers you typed in. Here is an example with the issuing NHS trusts details scrubbed from it:

    Not all authorities bother testing their machines in this way but the facility IS there and there really isn't any excuse for them not to provide this evidence that the machine was working correctly.

    There are three ways to tell if a parkeon machine is working correctly:

    1) Look for any flashing LEDs. If none, it's theoretically ok but this isn't 100%. I've seen machines with no flashing LED that refuse to serve P&D tickets.

    2) Press the cancel and issue buttons at the same time. Within 2 seconds the machines mechanism inside will usually make a little rumble and the screen will normally display a numeric error code if there is a fault. Again, this assumes the machine is healthy enough and clever enough to diagnose every fault it may have.

    3) The test ticket. Really the only real genuine way to know that the machine will print on a ticket and dispense it properly. Many CEOs don't bother with this as the councils don't even train them to collect them however they are the only real evidence a CEO / parking department can provide that will prove 100% that the machine works at the time that they've stated in their notes that it was a working machine.

    Hi Everyone,

    Just to advise you all, that after following the appeals process through, I have won the case and had the PCN rescinded.

    Since originally starting the thread on this website, I was advised by a fellow member to join the https://www.pepipoo.com site.
    I followed the advice and joined up. There I was given invaluable help and advice by some really professional people, who certainly knew what they were talking about.
    They advised me to continue with the appeal process and told me why.

    At times because it was taking so long, I felt like giving up but with their help and encouragement I stuck with it and eventually won the case.

    I got down to the Traffic Penalty Tribunal telephone hearing stage before gaining the decision based on a council procedural impropriety. They had inadvertently sent out a 'charge certificate', whilst the TPT appeal was in progress. They therefore, lost the case.

    If I would have just paid the fine, they would not have committed the error.

    So I whole heartedly recommend the pepipoo website, as an additional aid to queries on this website. They will tell you straight if you have a chance and why. Alternatively, they will also advise you if there is little chance of winning an appeal. Either way, you will also gain an understanding of how the appeal process works.

    I would also like to say a big thank you to everyone that has contributed to this thread, for their help and advice, which led me to down the appeal path and thus, a cancellation of the PCN.

    All,

    I am absolutely over the moon with the decision, as the PCN had risen to £75.00, due to the nature of the appeal process.

    With just having a newborn baby and not working at that time, I was extremely worried about finding the money to pay the fine. Then just before the decision, I gained employment and then got the decision. It seems that I am on an upward curve at present.

    If I was not encouraged to continue, then the council would not have made their mistake. The alternative would have been to just pay the fine. So you cannot argue with that.
