Thanks, So what you are saying is that if this was a legitimate process I would receive a court claim form following the bogus solicitors letters - and surely enough this hardly never happens and it finishes with a Graham White letter?
Also, is it common to receive phone calls during this harrassment?
With regards to further targetting, I meant approaches on site concerning the outstanding fee or clamping, but not sure if this is allowed anyway. I didn't mean further tickets as I will be paying from now on!
My only concerns with paying the fee is that some advise to avoid all correspondence not to implicate oneself, but as this will be with the land owner this hopefully shouldnt occur.0 -
to clarify,
'I didn't mean further tickets as I will be paying from now on!'
referred to the P&D and not the PCN!0 -
You have got it.
Its just hollow threats, in one of the Graham White letters he even spells out the charges, as if to make it look like you owe these charges now, even though they are for things like 'issuing warrant', 'warrant fees' and so on, even though he can't do this until he wins in court. Talk about misleading!
He's famous for only ever issuing one claim in all of the tens of thousands of threatening letters he sends out. He didn't show up in court and the claim was thrown out. He's not been there since.
No, the PPC shouldn't bother you in person, that would be harassment.
I wouldn't worry about incriminating yourself, they haven't got a legal leg to stand on.Je Suis Cecil.0 -
Graham White are under investigation by the Solicitors Regulation Authority for threatening people with legal action that they can't actually take.
It took the SRA years to finally deal with ACS Law, but we live in hope. The acquisition of wealth is no longer the driving force in my life.0 -
Hi there,
hope this is the right place to post this...
my request for help is slightly different.
I got a ticket last Saturday morning in Edinburgh. Basically, I had paid for the ticket on the 'new' RINGO service, which is usually great for the runs to the station for the train as you don't need a ticket to display!
My question isn't about revoking the ticket, but whether I can claim back postage & admin & distress for the mistake.
whe we make mistakes, it rightly & generally lawfully means we pay a PCN & admin fees for late payment.
Can i charge for this? why shouldn't I? I asked another parking attendant about the notice i received, he said we couldn't just ignore it as the charge would escalate.
thanks in advance...0 -
You have jumped into a thread about a private PCN so was this a private fake PCN? If so then you just ignore it and can't claim anything unless you want to take the firm to court for harassment.
If it's a Council PCN then appeal it but you can't claim for wasted time/postage.
YOU HAVE NOT TOLD US WHICH IT IS THOUGH!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You should really start a new thread so your question doesn't get lost in this unrelated thread.

If we reconvene here from yesterday where I left off, my wife informs me that we have received several phone calls yesterday and today from Roxburghe (she hasn't answered) but is concerned that we should have just paid it. I have told her what the situation is but she says its become a worry (and hers because I am not at home to worry about the phone!). Anyone know how long the calls persist, or if there is a way to stop them?
I am on the verge of writing a letter to the landowner as per 03-08-2012 12:30 PM Coupon-mad including the 50p P & D fee, but am only reluctant as I feel I will be wasting my time as it will make little difference - any advice?0 -
is this the same with NCP.
I have a couple of fines (forgot to pay on the App) and am getting loads of threats. I understand they cannot impose their "fine" but arent there bylaws for railway stations. Is it different?0
