  • So, good news this morning. After being ignored by Executive relations in Tampa and North Carolina, I was called by executive relations in California. The young girl who contacted me was unsure as to what the interest issue was as the basic checking account didn't accrue any interest. I explained that the interest was what the court would award the claimant as they were deprived of the money in the interim between extraction and refund. After letting her know my plan of action, exchanging numbers and getting her name we agreed she would call back by close of business on Thursday to address the issue. I guess this dialogue counts as arbitration so that cannot be brought up should this go to court. Good news then that I have actually been acknowledged, I shall let you know what happens on Thursday.

  • Was called this morning by girl in California exec relations. Agreed to call me back by close of business Thursday after acknowledging my grievance today. Will let you all know what happens but I suppose that this is good news.

  • I've been wanting to know the same thing!

    I printed out and sent the first letter - modified slightly - to my bank 6 weeks ago and have had absolutely no response from them! I was planning to follow up with a phone call or a 2nd, registered, letter, but have not built up the courage to do it yet!

    I am really worried that doing something like this is going to cause huge problems for anyone brave enough to get it off the ground (I'm convinced that that is why the original poster on this thread, johncolin78, has fallen silent!) - the financial institutions and credit rating bureaus in this country have SO much power that they could easily make life next to impossible for anyone who might make a stand against them!

    I'm estimating that I have been charged over 3,000 dollars in charges over the last 5 years since I moved here - I don't know the exact figure because the bank have totally ignored my request to tell me it! Additionally, because when I arrived I had "no credit history", I have been unable to get credit other than at grossly inflated rates and have been overpaying for my mortgage, home equity line, car loan and credit cards, which has led to a cycle of debt that I am finding it impossible to escape!

    Hey all,

    The only reason I have stopped posting on here is because I have been too busy on my own UK cases, I have won them all , and now I am aggressively persuing costs. I am going to file against bank of america in Ventura County CA next week.

    I have spoken to class action lawyers and they have encouraged me too bring this case.

    Do not hesitate for a second. Do not give the banks six weeks to satisfy your response. Get the case to court ASAP, esp if it B of A, you know how little they care.

  • Wow! That is really inspiring news! I really thought that you had been forced to give up!

    When you have the time, can you post your experiences here? I would really love to hear how you went about this and to follow in your footsteps!

    My bank is the Bank of the West - also in California - and I have been treated with total indifference by the staff at the branch whenever I have raised the issue of these charges!

  • So, I wrote to the head office of BotW requesting, for a second time - after my initial request was ignored, a total of charges that they've hit me with since I opened the account. This time I got a reply, from my local branch.

    They said (and you can smell the irony here!!!) that they would have to charge me 5 dollars per statement for a reprint of each statement for the life of the account (5 years and 6 months = 330 dollars) plus 30 dollars an hour for "investigation" - to go through with a highlighter pen and highlight all the charges, I'm guessing. Ha ha ha ha ha ha ha!

    Now, I program computers and I KNOW that they would be able to get the information that I am asking for in a maximum of 5 seconds just by querying the files on which this information is held!

    I'm not sure what my next move should be - I do actually have the statements in a file somewhere at home, so will probably go through them at the weekend with my own highlighter pen and calculate how much they have stolen from me (wonder if I'll be able to charge them 30 bucks an hour for my time???)
