I remain entitled to IB - their own report from ATOS shows no improvement likely for at least 2 years, so I wonder whether they can actually stop paying me IB until the scheduled review date in 2014?
Interesting legal point, and I wonder if it has been tested.

They can basically choose to review cases at any time they choose.
Once the migration process onto ESA starts, you are no longer on IB, you're in the process of transitioning to ESA.

    In addition.
You can be entitled to IB, and would be till 2014, but be migrated over to ESA, and not qualify at all.
Even if you would have still qualified for IB.
Simply as the descriptors for ESA and IB differ.
(I have no idea of your likely eventual ESA outcome of course)

Friend of mine got ESA50 in november, sent it back in december and were processed incredibly fast, faster than I have ever seen IB50 forms processed. Seemed almost too fast.

    Here is what happened.

She heard nothing for 2 months, I told her not to worry as delays are not unusual.

Last weekend she gets a letter stating she missed a medical during january (yep just one month after they got the form) and missed a reminder letter sent 3 days letter, as a result she is declared fit for work from march onwards.

So aside from a very fast form turnaround time, they have managed to kick her off in quick smart fashion, incidently she didnt get any letters about the assessment hence missing it.

Now trying to appeal she has discovered many barriers in place. No fax number available to fax letter, cant be resolved over phone, has to be written request, and no way to talk to a decision maker directly. Unlike when failing a medical, a claimant isnt entitled to anything whilst appealing a missed medical.
