caz wanted to ask some quick advice or any lawyers out there. I have a friend who's wife has walked out on him but now wants to move back into the family home and get a divorce and throw him out. Do you mind me asking because you have mentioned being forced to move out of your house because the ex is selling? My friend says that his soon to be ex would be entitled to live in the house as long as the children are under 16yrs and he wouldn't be able to sell or force her to move until then. Is this true. Could he obviously only do this if he couldn't afford to continue the payments on the house?

I'll write more in a PM later as you never know who is reading but it's a nasty situation. Mine differs as my name was never put on the mortgage but as the wife of the mortgage holder, I have rights. I'm not sure about being able to stay until the kids are 16 but I have seen that mentioned before but it's certainly never been mentioned to me by the STBX.

I was going to do the netflix but DD2's bf joined up with them last month (from my house) and I think I read somewhere that you won't be eligible if the address has been used previously :(.

I don't recall being asked the address during the sign up but I signed up myself and my folks so all above board.
The only winners in divorce cases are the lawyers... :(:(:(:(

^^ This. My solicitor is richer to the tune of 4 figures and the divorce & financial split haven't even been initiated.

The contact order case has been resolved and to the satisfaction of the judge and STBX. Why the STBX couldn't have accepted all the previous legal decisions instead of dragging this out for months beats me as it would have been cheaper and probably amicable. As it is, losing my savings for the sake of his bullying (and no, what he wanted was NOT in the best interest of our kids - the judgements back this up) and now being told that he wants back into the house and has no care where me AND his sons go nor how we can afford it shows me I made a bloody good decision last summer.

Kids deserve their father but there are times when a father does not deserve his kids. Obviously for legal reasons there's a lot I cannot disclose but I can say that there are numerous reasons why I am concerned for the safety and wellbeing of my boys when out of my care. I'm not being awkward or nasty for the fun of it (I couldn't afford it even if I wanted to be). I have the wellbeing of my kids first and foremost. Not once have I been asked if I can afford to pay the bills, feed the kids or buy nappies & clothes which is made even worse as I am on maternity leave. At least when the kids are older they'll see what I have done for them and that all their father wanted was to see me suffer and for all of us to be out on the street. One of his family members even suggested I return my engagement ring and move out into a hostel with the kids. Nice family eh
