JSA stopped

To be honest, I'd hold off on the reconsideration. Ask for a detailed explanation, this will involve you being given an appointment to speak to a decision maker for them to explain the law on which the decision is based. The moment you say 'there was an x month gap between the job ending and the date of claim' any decision maker worth their salt will reconsider the decision. Or at least commence reconsideration0
-
How do we do that ? Arrange for a detailed explanation ?0
-
Ask in the jobcentre, they will call the decision makers and negotiate an appointment0
-
Ok. Do you know if we need an appointment at the jc first ? And how do we make this ?0

Sorry, I don't know how jobcentres work, personally I would either pop in or phone them0

Just a little update as thought this thread may help others seeking advice.
I found the supporting info that dookar pointed me to and printed it off the dwp web site. As he rightly pointed out the decision makers guide clearly states the sanction is 26 weeks after employment ends - so my partner was exempt from sanction.
I rang the benefits centre and pointed this out but was told there was no way to speak to a decision maker directly and we would have to go ahead and ask for a reconsideration. I didnt get round to this immmediatly, partner signed on once (he told his advisor of what had been happening), then the follwing week we got a letter saying jsa would resume and arreas be paid into his bank !!
We have no idea what made them resume JSA as we never sent the reconsideration form into them !
Massive thanks to dookar who was an invaluable source of information :T0 -
No problem, glad you got it sorted
