Agree with the above, self imposed sanction exceeds the maximum sanction possible so they can't apply one

Thank you for taking the time to reply. Fingers crossed the job centre can sort this out tomorow morning ;)

Did they specifically use the word 'disallowance'?

That refers to entitlement questions, of which leaving voluntarily is not one.

Have they queried the steps he has taken to find work or his availability?

Thismorning when we discovered there was only 1 weeks jsa in the bank my partner phoned the benfits distribution centre - he spoke to a man who said that there was a disallowance on his jsa, but could not provide any further details. He then said he would get the decision makers to call us. This never happened and we got a call from a woman at the BDC, who said that his job centre had stopped his jsa, and she made the appointment for tomorow and told my partner that this disallowance was due to him voluntarily leaving employment.

He has not been unavailable for work, not missed any appointments and has been actively seeking employment - has applied for 3 jobs in the past 2 weeks and has email evidence of this.

Its easy to see, through reading this thread, that they dont know what they are talking about !!

Then they must have used the wrong terminology, which is good because it means the sanction is unlawful

    Probably not.

The difference between a sanction and a disallowance is rather woolly - most people get them muddled up, and all the benefits centres can see is a screen which has a disallowance code - all sanctions and disallowances have a code which is input on the disallowance screen, which is used for both sanctions and disallowances. They're also not trained on what they really mean.

In my experience claimants also better understand what disallowance means rather than sanction, which is why some people describe everything as a disallowance.

It's likely a sanction was applied - it sounds like it's been done incorrectly given the dates, but it seems odd it's been applied for a week.

OP - don't get hung up on the terminology. The JCP will be able to explain what it's for and how to appeal when you go in.

What does JCP stand for ?

JCP stands for Jobcentreplus which is the jobcentre.
  • Its a 26 week sanction  decision was made on 12th jan and apparently we should have recieved a letter giving details of this.

No more jsa for us then, though he still has to attend every 2 weeks to sign on for NI to be paid.

We can appeal for a reconsideration but Im wondering if it is really worth it at the minute.
  • The man at the job centre stated the sanction is only valid once a claim is made, so the date he left work is irrelevant.
