The man at the job centre stated the sanction is only valid once a claim is made, so the date he left work is irrelevant.

the man in the job centre is wrong
  • He was pretty insistent that he was right, can you point me in the direction of something that proves otherwise ? If I had some written evidence then I might have a stronger case, or something from directgov that I can print off ? I've searched but can't find anything :-(

Sorry I'm on my phone, so no link

Google 'decision makers guide' it'll be on DWP.gov then locate chapter 34 and your evidence is in paragraph 34051
  • Thanks, I'll have a go at finding it on my laptop !
  • Okay I've got that and you're right it supports what you have said, need to look at 26038 and 34054-34058 now, do you know which chapter they are in ?

The first twodigits of the paragraph number are the chapter - so 26 and 34
  • Thanks.
I'm a bit concerned about 34054, "when sanctions of discretionary length start"
    Would this be applicable ?
  • Thanks.
I'm a but concerned about " when sanctions of discretionary length start"
    34054-34057
Confused by 34057 - is this applicable in this situation ????

That paragraph covers the date on which a sanction should start but no sanction should applied in your case
  • That's brilliant.
Now - what to do next. I was given a form from jcp today for the decision makers to reconsider their decision - is this the route I should take ?

You are proving to be very helpfull source of information !! You should be very proud of yourself !
