Would have to be a woman driver to be able to rack up so many offences in an M&S car park, and on a sunday then believe she had "driven over a tin can"....:think:

Didnt see the 'Emma' my apoligies, but you are being disrespectful to all women drivers.
No need for the sarcasm and certainly not helpful to the op.
In fact it was down right insulting.

All you have done is make a fool of yourself.
make the most of it, we are only here for the weekend.

Sacrastic and sexist comments aren't going to help the OP much. I think she should see a solicitor first thing Monday morning.
I used to think that good grammar is important, but now I know that good wine is importanter.

OP, I suspect that you have received a Notice of Intended Prosecution and a s.172 Notice. It is usual for them both to be sent out at the same time.

For certain offences, including those listed on the NIP, a prosecution cannot occur unless there was a warning of possible prosecution at the time, an NIP has been served within 14 days (basic rule) or there has been an accident of which you were aware. Police forces tend to send an NIP to cover all bases, unless they were present at the scene and warned the drivers. This does not mean that there will definitely be a prosecution for all the offences listed on it though.

The s.172 is part of the investigative process. It is a requirement for you to identify the driver of the car at the time and date stated. It enables the police to take steps to identify the driver responsible for offences which have been alleged. It is an offence in itself to fail to respond properly to the notice within the time given on it (I think it's 28 days from memory). So make sure you do return the notice duly completed. I'd advise taking a copy of it for your records, and get a certificate of posting too.

The police may well then get in touch to take a statement from you or to interview you. If that happens, post back on here or go on the forums at pepipoo.

From the very basic facts that you've described, my hunch is that they will be seeking to focus on driving without due care and attention, plus the extra offences mentioned here of failing to stop at the scene of an accident and, having failed to stop, failed to report it. An NIP is not required for these latter 2 offences, hence their absence from the NIP.

You do not have to make ANY statement, you right to silence is absolute.

    Not 100% true.

You do not have to make a statement but you MUST, if requested, give the identity of the driver of the vehicle at the time, if you can.

A NIP is not required after a collision full stop.
