if you still have and are using the SIM then you are effectivly using the contract as it is the sim and minutes that you are paying for not the phone.0

No the phone was not free, even if there was no up-front charge for it. It was supplied for use with, and on condition of purchase of, a service under the Supply of Goods and Services Act 1982. It is irrelevant that the mobile networks split the goods and service into two written contracts as they are each interdependent at point of sale and supply....and if the phone was 'free' you have to be happy if they offer you £0.00 compensation instead of finding the missing phone and sending it to you as promised.0
