what does gross misconduct mean?

hi can someone please tell me in layman's terms what gross misconduct actually means, so what you would have to have done to get the sack for it. Thank you

  • It depends on the employment contract.

    Some things are pretty much universal - theft of property, theft of 'time' by fiddling clocks/not logging sick, breaking health and safety rules and endangering others.

    Other jobs like mine have specific clauses regarding piracy of software, !!!!!! at the office etc. etc.

    As others have said, its normally the worst of the worst that you could do. Generally means instant dismissal and removed from the premises.

  • Gross misconduct means its serious - your contact will outline what your employers classify as misconduct.

    If youve been invited to a disiplinary if outcome could result in dismissal without notice pay employers need to warm the employee.

    Can you provide more info please?

    Gross misconduct is that not drugs on the premises, being intoxicated at work, using comp time for other things, stealing, abuse to each other either racial or aggresion, trying to bully a colleague, use inappropiate sexual conduct all that type of thing

    some employers have different criteria on gross misconduct apart from the obvious. some have a confidentiality clause - some would count smoking on the premises as gross misconduct. You need to check the contract of employment as these spell it out - and what to expect if you are either suspended or dismissed or face discipliniary charges. The contract should also tell you how to proceed - such as contacting a union rep or solicitor or whether you could have a colleague present at any proceedings. If this has happened to you - be especially careful to follow procedure and GET either Union or Legal advice.
  • In practice, it means you have five minutes to leave the premises and your P45 will be posted to you in due course.


    Drugs, being drunk, fighting, stealing, falsifying records, breaking confidentiality, sleeping with the boss and then dumping him, groping the office junior, whatever.
