Eh? Hotels give earliest book in times not latest.

Yep. Latest check out time and earliest check in time.

You can even check in at 11pm or later (although some hotels require you to call them 1 hour prior to arriving or notifying them by a certain time on check in day that you wont be arriving until late).
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride

One of reason I didn’t take the car they offer me at 11am was a small fiat punto with only driver and passenger front air bags the car I booked was a 2L Vauxhal insignia which is a lot safer I would never want to do 70mph in a 1L punto.

Now you are really starting to lose my sympathy. Don't be so precious.

It is sounding more like you threw a strop and cut off your nose to spite your face.

I am sure they will offer you a free hire or an upgrade but don't expect much more.

first off I am not asking for your sympathy but thanks for that, so if you were planing to go away with your wife, booked a car in advance to be picked up at 8.30am then only to receive a phone call that morning telling you, you can not have a car, so what would you do? open a bottle of champagne and celebrate or would you be total peed off ? i was only phone up a hour later with the offer of a 11am car
i phoned the hotel informed them of the problem they quoted T&C, because i got a savers room reason for checking time.

You cannot claim for "coulda woulda shoulda". You can only claim for provable losses that arise as a result of their breach. Can you prove you definitely lost the commission as a result of their breach or is there a chance that you might not have gotten it anyway?

You cannot claim your hotel AND loss of commission as this would lead to you being compensated twice over. If you had gotten the commission or not, you still would've paid for the hotel. Likewise I think you might struggle to claim consumer contract and loss of commission.

What evidence do you have to prove you tried to mitigate your losses? This is a very important part. You have an obligation to try to do so to keep your losses to a minimum. Did you call the hotel and ask them if you could check in perhaps 30 mins late? Did you call the client and advise them of what happened and ask if they were willing to wait or reschedule? Did you call and get a price for a taxi? Will the train timetables reinforce your claim a train was impossible or will it show the opposite?

You cannot simply turn down a car because it only has front airbags (I thought it was only you and your wife anyway?). As above, you have a duty to mitigate your losses to keep them to a minimum. The only way turning the alternative car down would likely be acceptable is if the hotel wouldnt show any flexibility and you would lose your booking and your client wasnt willing to wait/rearrange either.

when i received the phone call i contacted 2 other hire car company's in the area (we only have 3) there was no trains at that time, contacted the hotel informed them of the problem nearly a hour later i was contacted again by enterprise offering me a car at 11am but with all the hand over checks they said it would be close to 11.30.

i did everything possible to find alternative transport, the commission part dosnt bother me its money i never had but the hotel i paid for and am now out of pocket.

didn't think he was asking for you sympathy, thought he was asking for consumer advice.

You have every reason to be "peed off" and if indeed the hotel had a check-in cut off time then this would be the only consequential loss that I can see you have incurred. Please tell us the name of this hotel as this sort of check-in policy seems very strange indeed?

Hello R0b1n, some of the replies are a bit harsh as you were only asking for some consumer advice on a consumer advice forum.

The contract you enter into with Enterprise was to supply you with a car at 8.30 they failed to do this and didn’t give you any warning that this might happen.

You then attempted to find another car without any success also you could not cancel or extend your cut off time for the hotel.

(hotel cut off time is up to the hotel not for people to assume when it should be I myself over the Christmas period stopped at a hotel with a 12 pm check in time fail to arrive by 1 would result in the loss of the room, this is so they can resell the room, my argument with them was, well the room is paid for they replied but you are not spending money in the hotel (food/drink)

Enterprise has breached the contract by not supplying you with the car at the time agreed.
When they contacted you later offering you another car which would be nearly 3 hours after the agreed time is just a way of trying to show they attempted to rectify the breach, but it looks like they clearly know you would not make it in time with the 11am car so it is a worthless offer.

!!!! happens, yes I would be seriously hacked off if I were in your shoes but at the end of the day you have to go with the hand you are dealt.

But to say you couldn't drive the Punto is being silly.

I think you are perfectly entitled to some form of goodwill gesture as I stated in my first post. How much you get will be down to charm and not threats. I very mch doubt you re entitled to any "compo" as that is all too vague re "possible commission". You could still have got to the hotel but chose not to.

I myself would never want to drive a small Punto at 70mph on a busy motorway, have you seen the crash safety videos for some of these 1L cars at 70mph, i have 2 cars, a large car for motorway driving and a small car for going from village to village but that's my opinion

how would he have still gone to the hotel if he missed the check in time
