its a year payment free not after 4 years, we had a sofa took a year payment free (after having sofa delivered) and then started payments after a year for 3 years. just insist you cannoy pay,im sure when we took ours out we werent told if we were refused credit we would HAVE to buy the sofa! thats ridiculous, sounds to me like the lady made a boo boo and is scared of getting found out! just insist they should not have ordered the goods before the credit check was compete!mummy to 3 monsters!
trying to money save, but spot too many bargains on here!!0 -
If the order was NOT 'subject to credit acceptance' then simply send them notice of your cancellation by registered post. Then all they can claim is provable losses. The sofa itself is not a loss as they can re-sell it.
Check the paperwork though to see what it says about credit. Can't say i'm surprised that this has arison though, DFS aren't very well spoken off these days.0 -
As I see it, OP did a deal where seller offered credit and OP offered to settle credit. As credit provider does not want to deal with OP, the whole deal is off.
If OP had done a deal and said 'I will go to my bank and bring back cash' but bank rejected loan application, OP would still be bound. But as it is the seller who is acting as credit broker, I would say the deal is off if they cannot provide the credit they offered.Hi, we’ve had to remove your signature. We have just purchased a DFS sofa using there interest free finance and had the same recorded message played and it advises you about the finance and the 14 day cooling of period for the finance only,it also states that you would have to find alternative means for payment either a debit/credit card or cash if you do cancel the finance, but it states that the furniture cannot be cancelled.
Also you do need to read the t&c of the order you signed as I do believe it also states it there as well.
Sorry to be the bearer of bad news.0 -

DFS did not cancel the finance as OP said the finance was declined.0 -

So are DFS going to honour the finance agreement they quoted to the customer at the time of sale in order to secure the sale then?
Or are they going to say "sorry we cant offer you finance in any other way"?You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
Contact DFS and tell them in no uncertain terms that you simply cannot go ahead in the absence of finance, and say that you will not accept delivery of the goods.
This firm pulled a similar trick on my 81 year old mother after she purchased what she thought was an electric recliner chair over the telephone. Sadly they made a mess of it, and it turned out that what they had actually ordered for her was a manual recliner (which she couldn't use because she had arthritis in her hands). However instead of just changing the order as my mother wanted the sales woman blamed her for the mistake and said she would have to accept the chair as it was. Because the contract was made by telephone my mother had a legal right to cancel, which she did. Following the cancellation several abusive phone calls were received from head office, the saleswoman and even the shop manager. They never returned the deposit either (even though they were legally obliged to).
Do not let these people brow beat you. You made your position clear, stick to it.0 -

Why would they honour the finance.??? and while I'm not defending DFS why do they have to be sorry when the OP was declined for finance, but I am in agreement that furniture should be cancelled.
Out of interest OP what DFS store did you go to.0 -

I wasn't even there but to e it would be obvious that this is a chicken and egg situation. OP needs finance to enable the contract. Therefore shop is duty bound to do things in the logical order ie
1a Arrange finance
(1b Confirm finance with customer)
2 Order Sofa
Doing it it in reverse order is at the very least immoral and illogical if not illegal.
I have been on the receiving end of sharp practices like this when I leased a car through MercedesBenz finance. I asked whether VED was included was told yes. Neeedless to say 1 year later I discovered that it wasn't. I called to complain but of course nothing in the paper work backed me up and the broker had gone out of business even thoug the new company was trading under the same name of Purple Contracts.0
