eBay seller charging £5 handling fee for returns under DSR

    They will find out the hard way that their statement is incorrect. I know you won't but again just to reiterate, don't close the case.

    They might be a Powerseller but it doesn't mean much to anyone these days.

    Sorry are we talking an eBay case or a Paypal case? I believe that you can escalate either once the seller has posted a message on the case. If you have to post a message to the seller I would say:

    Thank you for your message, unfortunately I can not close this case. Please either agree the refund via this case or I shall have to ask eBay to review the case, either way the goods will be returned to you by Special Delivery for a refund of 93.99 via this case and I do not wish to discuss the matter further. As the goods are not described due to the lack of pads under the arms I expect you to refund my return postage as well. I can see from your feedback others have complained about the similar problems and I have spoken to my local council's Trading Standards department who have confirmed you are legally obligated to refund my original payment in full as well as my return postage and they have asked me to call them back to confirm whether you do so or not so they may either close their records or take the matter further.

    I enjoy a good old complain if I know I'm right and the seller wouldn't be getting off lightly with me! but always keep it calm, factual and polite so they don't have a leg to stand on.

    It's an eBay case, don't know if that makes any difference?

    I would just respond with....

    This case will only be closed upon full receipt of my refund.

    I shall refer this case to EBay to review. I shall also ask for my returns postage of £x be refunded as the item is described incorrectly by you.

    .....then I would escalate if it's possible. You usually have to wait xx days until eBay review it. They will then tell you to return it or give a no fault refund or tell you to return and give you a returns voucher.

    Whatever you do, under no circumstances should you close the case. If the seller refunds it closes automatically. I would not converse further with them. Keep the last statement in your response brief as it will be the last (or ony!) bit the eBay team read!!

    I have replied to the seller and will send it back this week.
    Your message to the seller:
    "I will be sending the jacket back via Special Delivery. Once it is received I will expect a full refund of the price paid, plus my postage of £4. This case will only be closed upon full receipt of my refund. "

    UPDATE:

    Returned the jacket, got my refund of original purchase price plus P&P (not return postage)

    Left negative feedback and poor stars for as described and communication, five stars for despatch time and postage charge; 'Worst ebay experience ever. Tried to charge £5 for a return'

    Today I have a feedback revision request and a threat that if I don't revise my feedback, they will open a claim for defamation against me....

    Anyway, should I simply ignore the request and their message?
