eBay seller charging £5 handling fee for returns under DSR

They can't do that, surely? Seller is a business seller.
Item is being returned as too small, despite ordering as per their size chart.
Have gone through returns process on eBay and it says the seller needs to approve it first - can I not just send it back tomorrow?

If it's not as described then the "changing your mind" rules under DSRs are not applicable. For not as described the seller should pay for return postage and refund the full amount of the product and the original postage too. If they offer anything else report them to Trading Standards.They can't do that, surely? Seller is a business seller.

Is it not as described or did I just measure myself wrong?! I measured myself and compared it to their size chart. It ended up being my normal size anyway but it is tiny.

Assuming the item wasn't an auction, no they can't do that, just open a eBay Not As Described Dispute and neg the seller for failing to offer your consumer rights. At some point send them this link:

As above open the dispute and neg the seller once it's resolved. I'm not usually one to say leave a negative but the £5 "handling fee" is completely illegal.In the game of chess you can never let your adversary see your pieces0

I have sent a message asking for a returns number. They have until tomorrow night, then it's dispute time.
I've read the listing and the item is SNAD, regardless of the size issue. It's meant to have rib panels under the arms and it doesn't. So tomorrow I will open a SNAD if I haven't heard from them. It's an expensive (for me) item at £90.
Had a crappy week on eBay - got negged by a buyer who didn't like the colour of an item the other day!0 -
I've opened the dispute now. I'm limited as to when I can visit the PO to send it Special Delivery, and hubby can go on Friday. Hopefully they will reply by then!0

It's not "illegal", it's unlawful. You can't be arrested for itOne important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0
