eBay seller charging £5 handling fee for returns under DSR

    It's illegal as there is a law which prohibits it specifically. Unlawful is a breach of the spirit of a law, i.e. not specifically detailed in the act but clearly against the meaning.
  • To avoid being criticised further I'll clarify: The £5 handling fee is prohibited by Government legislation.

    It's not "illegal", it's unlawful. You can't be arrested for it
    The police may not come knocking on your door, but Trading Standards do have powers to arrest and prosecute if someone acts against consumer law, so it wouldn't be just a civil matter.

    Seller has replied to my SNAD telling me that if I want to return, I need to send a return request (did that Tuesday night) not open a SNAD claim. They then ask me why I think it is not as described (gave full details of this in my SNAD claim)

    Feel like banging my head against the wall. I still have no returns number and the seller does not understand it is not as described.
  • I would ignore their comms and escalate the case, as long as you return the goods via a tracked method and delivery is attempted you'll get a refund.

    Out of interest how much feedback does this seller have for the last 30 days?

    Don't be fooled into closing the case and using their returns procedure now, if you do you can't open another one and you will be at their mercy. See it through and return only when Ebay, or paypal tell you too. Remember to send it tracked so you have proof of delivery (or attempted deliver) and upload it to the case.

  • Yeap they are what I'd call a 'proper' business, I'd report your experiences to Trading Standards either via your local council or via Consumer Direct. They clearly have no clue what the DSR regs are which in this case is causing you an inconvenience that you shouldn't have to suffer.

    So I do nothing til the 20th then escalate the case?

    Do I ignore the sellers email? They have not replied to the case but have replied to my email asking for a returns number. See below:
    Dear eBay-buyer,

    Hi


    If you want to return a garment you need to send us return request, not open a claim against us.
    On what basis you claim jacket is not as described?? We have a 7 day return policy for whatever the reason.
