Can anyone help on my Cash4phones and the Royal Mail dilemma

I dont know why you are even bothering to post anything on here, as you now seem to have turned on everyone, aggressively defending the RM. However, I personally have never once in this thread said I think the RM should be liable, the reason for this is the reason for my original post,I do not know who is ultimately responsible! It looks as if it is cash4phones and I have stated this so do not understand your reasons for posting the above comments!
All I required is proof that my parcel was delivered and to where and this is all the information I would expect to get from the RM site, once again, I have never said anything regarding how much information I, personally can get, but I did state my opinion on how I thought it would be quite simple for the RM to check the deliveries against the signatures of the recipients for that one days deliveries to this company.
I personally do not understand your quote, again, it is more of a sarcastic question than any kind of useful information!
This is very stressful for me and to be honest, when I read your (mostly) condescending and rather angry sounding comments, mainly arguing with other people who are giving their genuine opinions and advice, all I see from you are these outbursts, none of which are helping me or answering any of my queries, it is a little disturbing and upsetting and I would appreciate it if you could refrain from simply lashing out?

Firstly, you have my sympathies.
I won't get involved in any of the arguments, but I believe you are in a very difficult position, which probably explains the advice given:
- Recorded Delivery only gives proof of posting and a signature on delivery. Royal Mail have done that and they will consider that as job done and will (probably) deny any claim for non-delivery of the item given that a signature has been obtained (and probably point out that Special Delivery is the service for high-value items whilst they are at it). In reality of course, that signature could be anyone and doesn't prove that the item was delivered to Cash4Phones, even if it almost certainly was delivered to their address.
- Cash4Phones will deny ever receiving it. The signature unfortunately does not prove it was delivered to them.
So the options open to you are as follows (IMV):
- Complaints procedure at Royal Mail (likely to fail because the item was only sent by RD and they have a delivery signature - even if that could be anyone!)
- Small claim against Royal Mail (relying on your case convincing a magistrate)
- Small claim against Cash4Phones (as per above)
Tough choice as (IMO only) your chances of getting the value of the phone are significantly below 50% with all of those options.
You are not alone in placing undue faith in the Recorded Delivery system, and your post has highlighted to me why almost every time I have sent a letter or package by Recorded Delivery at the Post Office I am asked "Is there anything of value inside?".
For RD you are effectively paying your additional 77p for the reassurance of knowing whether the item made it into the system and getting someone's scribble on a piece of paper at the other end (if you are lucky - in my experience a lot of safely delivered items don't even get a signature if no-one is home and the postie decides to take the risk of just putting it through the letterbox rather than taking it back with them). It also makes it slightly easier to claim compensation for loss from RoyalMail if the item doesn't track and/or is not signed for - a proof of posting certificate does almost the same job and just requires extra chasing up with Royal Mail to get them to pay compensation for loss.
I'll be interested if someone is able to add to the three options I listed though. And again I stress that I sypathise with your plight.0 -

They do pay for lost - though in this case they woouldn't because it isn't.
I am amazed at the mess that has been made of this simple thread/situation.
Again, send the LBA to the dealer and sue if they don't pay. I believe youwould have every chance of winning should they go to court (which i doubt) since you have proof of delivery. It is up to THEM to prove otherwise - and that will be extremely difficult where YOU have proof of delivery by Royal Muckup.0 -

Yes, it IS out of order; just couldn't think of anything STRONGER with those characters. After all, I pay for sending mail which goes missing, takes an unpredictable time to arrive (if at all), see my post disappear when I PAY for redirection AND get no response from them worth a you-know-what (could make up my own characters this time but don't like to be crude!). As for my deliveries; they can arrive any time between about 1030 and about 1730. today it was around 1530. But Monday is anyone's guess... just as well this country is so inefficient that we don't have to bother waiting for our post (despite being self-employed) and that we don't have to compete with the rest of the world....
Where RM is concerned, NO criticism is "out of order" - it merely relfects their standard of performance (when they can be bothered to perform at all, that is).0 -
If you have such a problem with RM why arn't you having all your post delivered/sent by courier?
Changes are happening within the organisation, not for the better I might add. The staff on the ground arn't happy and have'nt been for a long time. But not to worry their won't be a national postal service in the next 5/10 years. It'll be split up like the trains/buses and then you won't know who to complain to about your redirections0
