You answered a question that I didn't ask. A county court is not involved in determining whether a chargeback is valid - its either the retailer or the payment processor. County court is only involved IF either party raises a small claims action, NOT in the first instance (which was what I asked). ;)

But Fasthost saying it is them.

That's what I suspected. And since they've already said the auto-renew is valid then any chargeback is almost certainly going to be rejected.

My point is your answer to my post (previous page) was incorrect, because you answered a question that I didn't ask. ;)

Yes - court is an option. And your comments are probably correct in this respect. But courts don't decide IN THE FIRST INSTANCE whether a chargeback is valid. And THAT was what I asked. :)

You never asked who determines how valid it is in the first instance, you asked who determines how valid it is. The merchant account supplier will make a decision on the chargeback, then Fasthosts will decide whether to enforce the term -- then either party has the option of having the dispute independantly decided upon, via the courts.

They would also have to justify the fifty pounds.

Not necessarily, if it's a B2B contract and fasthosts can persuade a court that the chargeback was unfair then I don't see why they need to justify it. Lots of B2B contracts involves penalty clauses.

I think your psychic abilities are on the wane. You made your own interpretation of what I was thinking. ;)

But, whatever. Enough now - lets stick to the OPs issue. :)

  • I emailed fasthosts to ask about auto-renewal email. This is what they said:

    Dear XXX,

Thanks for contacting us with your support enquiry.

I am afraid but we don't send email confirmation once you turn off domains auto renewal on the control panel. The only way to check it is through the control panel.

    Thanks again for contacting us.

Now we have a situation. I've found a print screen with date and auto-renew off. Having thought about it, this the plan is:

    1. Email FS today with print screen and ask for refund.
    2. If no, transfer my active domain name (just registered a new one with TSOHost as saw problems with FS). This will stop them blackmailing me by cutting off my domain name.
    3. Request chargeback via bank.

    Let you know what happens.

Like Martin says you gotta stand up for rights.

  • Thanks one and all. Fasthosts refunded the money. Like Martin said you gotta be rough with companies. You should also be as firm as me.

  • Hi,

For what its worth im 100% sure that i had set autorenew to off for 2 domains that have just auto renewed. I was actually in there the other day and set the 3rd variant of this particular domain (same name different extension) to not autorenew and im 100% sure the other 2 were showing as auto renew off otherwise i would have also set them at that time (and yes i know u have to confirm it). I don't have any proof of this - have just taken screen shots of all the settings BUT as someone else said there isn't anything to say that my screen shots aren't either faked OR done after the incident if u tried to use them as proof. I have just asked fasthosts to tell me when i set this 3rd one to not autorenew to see what their response is. But they have told me to get lost re my claim that these other 2 were definately set to not auto renew. Been looking arouns the net and they seem to have a history to auto renew trickery! I would shift all my domians to soemwhere esle but with over 70 in there its too much hassle..... I will not be registering any new ones with them from now on though!....
