She is incredibly gullible, but not guilty of fraud. She may be considered negligent as it's plain as day that this guy was up to no good but he has at the end of the day committed the offence.

You need to take a step back here and think about it.
She gave her account details and personal pin number to a third party on the "promise of easy cash" - Your very own words. It is expressly against the terms of a card to divulge your pin number for your own protection. She did it because she thought she could scam some easy money and it's not a lot different then receiving stolen goods and then pleading innocence because you didn't actually steal them yourself.
She ought to consider herself lucky if she gets away with losing the money and not be investigated for her actions.

Pay it off, make sure the bank details are all changed and put it down to experience. Taking it further will cause your daughter a lot more damage in the long term. It does appear she was a willing party to fraud.0
