You can ask for anything you like, whether they accept it or not is another thing.
I suppose you could write to them giving them the opportunity to remedy their breach of contract to a satisfactory standard -- if after 30 days they haven't responded have the work done yourself and sue them for the costs. You would though need to get a few quotes to prove you mitigated your losses. If your still not happy after that though, due to the time factors it's unlikely you will now be able to reject the vehicle for a refund.0 -
looked at car, had small dent in door, dealer said he will sort it if we agree to buy.
we said we would buy on condition of this being sorted.
went collect car week later, dent fixed but paint wrong colour, went back 3 times with issue still there.
after 2 months of this dealer said they would send car to a proper body shop and not back street one.
this time car had rust coming through rear arche, dealer said this is covered under warranty and will do door and arch at same time.
month later car went in, came back week or so later and it was a mess, paint wrong colour, filling was rubbish, lines on door didnt match qtr panel and werent straigh, they bended in middle, different from other door, the repair looks like chip wood wallpaper under the paint. qtr panel similar after rust repair.
dealer agreed repair wasnt great so sent back, came came back after few days. bodyshop did nothing, just polished door and qtr.
dealer said well thats it, we not doing anymore.
took car to a approved bodyshop, who did report, it said all above needed doing and would cost 1200 pounds to fix.
called finiace company who sent a independent inspector out, who checked everything on car, his report says door needs to be stripped back to bare metal and redone and does qtr panel, he also found car had two different colours on it, paint flacking off around door handle etc etc
he said it would cost around 1100 to put right, and beleived this isnt of a good standard.
finance company had this and agreed work needed to be done and called dealer to sort, dealer refuses and say works is ok and not doing it again, then finiace company then agree with dealer and said, dealer not prepared to do it, so we cant force them, they say work is ok and we stand by them, even tho they had this report they paid for.
consumer direct says this falls under the sales of goods act ( implied terms ) and i have a case.
what do i do now, clearly car has been repaired right and this will have a knock on effect if i sell this car, if i repair it im out of pocket by at least 1k.
what should i do, i cant really afford court etc, advise please. ive emailed all reports and picks and letters from finance company and dealer to consumer direct0 -

option 1.
obtain your own independant report
send to CC company and file a section 75 claim with your evidence
if they continue to reject the claim, make a formal complaint then go to the ombudsmen
option 2.
obtain report
send this to dealer giving them opportunity to sort out
if no response, repair at own cost
pursue dealer via courts for cost of repair
option 3.
if they fail to remedy it within 'reasonable' time (probably already passed reasonable time), stop using vehicle and reject for refund under sales of goods act
if they fail to collect car, send LBA
go to court (moneyclaim.gov)
Take your pick.
people are less likely to help you if they think your just going to ignore the advice and start a new thread next month0 -

Thank you for adding all together. I couldnt find the other one on page. Im on my phone and itsnot very easy to navigate around.
I have spoken to consumer direct. They say file with financail ombudsman as the agreement and car is with them. and any action would be against thwm. Supply of goods act implied terms.
If car is not in resonable repair or fit for.purpouse or worth money paid etc etc. Not to sure on it all but Ill prob file with the.ombudsman.0 -
