car and rejection

basically we found a car at a main dealer, it had a little dent in the door which needed repairing, we said to the sales manager, that we like the car but no the dent.

he agreed if we buy the car he will fix it like new, and put this on to the order form for the car along with another key etc.

we went to collect the car but noticed the repair on the door was a bad job and was infact the wrong colour lol
sales manager said sorry and booked car back in to have it re done, we got it back and there was still issues the line on the door was like a wave and not straight, the bodyshop said they cant really do any better as they were only a 3 man team, so the dealer agreed to send off to a seat approved body shop. the car was booked in, car sent off to them and the door was re done, got the car back and the door was even worse, the filler in the door was prominat through the paint, the line was wavey again overall a very poor job.

i asked the dealer to re do as the job was of a poor standard and i wasnt happy with it, so they sent car back to the body shop again, it came back and was even worse, this time 2 tone paint work on the car, and the filler and line on the door still the same, they basically tried to cover it with more paint.

the dealer has now said sorry its of a good standard and we wont re do the door at all.

i called seat uk and they said its upto the garage what they do, but advised i get it inspected by another approved body shop, so i took it to another seat approved body shop who are also approved by merc, prosche, ferrari, bmw, audi, fiat, seat, vw etc and are kite marked body shop aswell and thatcham approved.

they did a inspection and said this car would have never even got near the door if we did a !!!!! job like this, he said its the worst repair he had seen, and said the dealer was very foolish to say the work was up to seat standards as they havent had it checked them selfs, just gone by what the body shop had done.

so the inspecting bodyshop are going to write a report and costing of putting the work right etc.


my question is, what can i do when i have this report. where do i stand on the law with this.

your opinions would be so grateful

    Repair of the damage (to an acceptable standard) was part of the contract of sale. Seller has breached the contract by not doing so. You are entitled to a full refund. (IMHO).

    By under what law.

    They say the work is if resonabke standard. And will keep taking that stance, I've also emailed the same to my local trading standards office also.

    They won't be fobbed off with me just saying its not acceptable.

    Looked at car, had dent. Dealer agreed to reapir if we bought. So bought it. 9k repair was done ready for collection but colour was wrong. They sent back had re done. Agin wrong colour, again they sent back and it came back right colour but the line on door was wavey.

    The car needed warranty paint work done so they said they get dent done and warrnty work done at the approved bodyshop. Car went and came back week later in worse condition then it was before going in. Dealer has said they not doing it anymore. I've had the car inspected and the independant bodyshop say car needs 1.1k of work to out right. I contacting the finance company who has had car inspected themselfs. The inspector agrees car needs work. And the report already done is correct.

    My question is where do I go next.

    Ask for work to be done.
    Ask for refund of the money or reject car. As the car is below an acceptable standard.

    I know the finance company are liable as they buy car for.me and we hire of them until paid.

    Please asap please. I don't really want to be out of pocket for this.

    Reject the car. You have finance so contact the finance company to reject the car and request the finance to be terminated/annulled/insert expression of choice, and any monies paid by you to be refunded.

    Well I've spoken to the company today to ask what options are avaloable. They were unable to comment as they need to speak to the dealer.

    The car was bought for 9k. Repair cost would be £1.154.

    The dealer is still refusing to repair it. Even tho it was on paperwork for condition of sale. And 2 independant reports by experts. One by someone who does reports as a living for compqnys and also a approved bodyshop who are accredited. The car is a seat and the bodyshop are seat approved.

    If I reject the car, I understand I still need to pay for it. Until either company agree it or a court do it.

    I don't fancy paying for car I don't have, I understand ill.prob get it back but need a car for work etc

    You should not stop payments until confirmed by the finance company. You will also need to stop using the car immediately and make it available for collection by them. Not really much you can do about it tbh, so you will need to find alternative travel arrangements.

    What other options could I ask for. Because I actually like the style of car etc but not the poor repairs.

    Can I ask for repairs to be done at a garage of my choice and they get bill or exchange car like for like, or cash payment
